SUBJECT:                     Right-of-Way Acquisition - County Service Area No. 32 for the Fresno County Westside Groundwater Project 

 

RECOMMENDED ACTION(S):

TITLE

Accept the Grants of Easement and authorize the Chairman to execute the Right of Way Contract and Temporary Construction Permit required for County Service Area No. 32, Fresno County Westside Groundwater Project for a total monetary consideration of $2,500.

REPORT

Approval of the recommended action will authorize the purchase of additional right-of-way on West Clarkson Avenue at a cost of $2,500 (shown on Exhibit A, attached).  This acquisition will facilitate construction for the portion of the project benefitting County Service Area No. 32 (CSA 32), for the Fresno County Westside Groundwater Project.

 

ALTERNATIVE ACTION(S):

 

The Board may reject the purchase of this right-of-way.  This would require staff to re-design the project utilizing existing road right-of-way that is developed and includes existing utilities.  In contrast, the proposed right-of-way for acquisition (as shown on attached Exhibit A) is not developed and has no existing road or utilities, allowing cost savings for design and construction. 

 

FISCAL IMPACT:

 

There will be no Net County Costs associated with the recommended action.  County Service Areas No. 30 (CSA 30) and CSA 32 have a combined funding source but are separate projects and this acquisition will only benefit CSA 32.  Both communities meet the criteria to qualify for 100% grant funding as severely disadvantaged communities, with median household incomes below 60% of the state average.  Appropriations have been included in the FY 2016-17 Adopted Budget for CSA 32 Org 9172.

Parcel 1 - Susan Rusconi, et al; 1764 N. Dower Avenue, Fresno, CA  93723 - $2,500.

 

Of the total compensation authorized pursuant to this Agenda Item, $300 is for a temporary construction permit with a useful life of 12 months from the start of construction, and $2,200 is for a pipeline easement and access easement.

 

 

 

 

DISCUSSION:

 

The County formed CSA 32 in 1981 to provide water, sewer, garbage collection, street lighting and recreational facilities services for the 73-lot Cantua Creek farm labor housing development, located at Clarkson Avenue west of San Mateo Avenue, approximately 30 miles southwest of Fresno and 3.5 miles from El Porvenir.  CSA 32 also provides water service to Cantua Creek Elementary School, Cantua Creek school homes, a mobile home park, and three residences outside the CSA 32 boundaries.

 

CSA 32 has water treatment and distribution systems serving the community.  The water treatment system is under State Water Resources Control Board (SWRCB) compliance orders for exceeding disinfection byproduct maximum contaminant levels. 

 

The Department of Public Works and Planning has secured a grant through the SWRCB for the design of a project to develop groundwater systems for the community. The proposed project consists, among other things, of drilling two potable water wells at CSA 32 and connecting these wells via pipeline to the existing water facility currently serving the CSA.  The wells will be drilled at the location shown on the Exhibit A, attached.  If the Board approves the Recommended Action, the pipe will be constructed in undeveloped land without underground utilities. This will eliminate the need to install pipeline in current County road right-of-way where paved roads and multiple underground utilities will need to be avoided, hence making the project more costly.  It is anticipated that construction may commence in the spring of 2017.

Parcel 1 - Susan Rusconi, et al property - This payment is for a 0.1239 acre pipeline easement, 0.0760 acre access easement, 0.2180 acre temporary construction permit, and severance damages to the remainder, if any.
