SUBJECT:                     Agreement with LA County - Automatic License Plate Recognition

 

RECOMMENDED ACTION(S):

TITLE

Retroactively approve, ratify, and authorize the Sheriff, or his designee, to execute the agreement between Los Angeles County Sheriff’s Office and Fresno County Sheriff’s Office for Automatic License Plate Recognition (ALPR) equipped law enforcement agencies to share law enforcement information, executed on November 19, 2019, which may be terminated by giving the other Agency Party at least ten (10) days written notice.

REPORT

There is no increase in Net County Cost associated with the recommended action. Approval of the recommended action will retroactively approve and ratify the Sheriff, or his designee’s signature on the agreement, which was fully executed on November 19, 2019 between Los Angeles County Sheriff’s Department and Fresno County Sheriff-Coroner-Public Administrator’s Office for ALPR equipped law enforcement agencies for sharing law enforcement information. The Sheriff’s Office brings this item to the Board ratifying the then-Assistant Sheriff John Zanoni’s execution of the November 19, 2019 agreement between the law enforcement agencies. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. If the Board does not approve the recommend action, Sheriff’s Office will not be able to share law enforcement information for ALPR with Los Angeles County Sheriff’s Office.

 

RETROACTIVE AGREEMENT

 

The recommended agreement is retroactive to November 19, 2019 to retroactively approve and ratify the signed Agreement between Los Angeles County Sheriff’s Department and Fresno County Sheriff-Coroner-Public Administrator’s Office. The agreement was fully executed on November 19, 2019.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. Approval of the recommended action will ratify the then Assistant Sheriff’s signature on November 19, 2019 for the recommended agreement. 

 

DISCUSSION:

 

Approval of the recommended action will ratify the signed Agreement between Los Angeles County Sheriff’s Department and Fresno County Sheriff-Coroner-Public Administrator’s Office for sharing law enforcement information of the ALPR. It should be noted then-Assistant Sheriff Zanoni executed the agreement at the time Sheriff Mims was in Office. Approval of the recommended action will ratify his signature. For any future data sharing agreements, the Sheriff’s Office will seek Board’s approval. This was an oversight by the Sheriff’s Office.

 

The Sheriff’s Office entered into an agreement between agencies with Los Angeles County Sheriff’s Department for ALPR equipped law enforcement agencies for sharing law enforcement information on November 19, 2019, which authorizes the release of scanned plate and hot list information residing in their respective databases or networks to other Agency Parties as permitted by law. The agreement provides Agency Parties and authorized users shall release or make available information accessed from an APLR repository only to persons or entities authorized to receive ALPR information as stated in the Agreement. The term of this data sharing agreement commenced on November 19, 2019 with no expiration date. However, this agreement may be terminated by giving the other Agency Party at least ten (10) days written notice.

 

The agreement provides that each agency is solely responsible for all claims, demands, obligations, actions, causes of action, suits, losses, judgements, fines, penalties, expenses, liability, damages, and costs arising from that agency’s negligent acts, errors, omissions, or willful misconduct incident in the performance of the agreement, including data breaches.
