SUBJECT: Amendment I to Master Dual Jurisdiction Cooperative Agreement with City of Reedley for Maintenance and Repair of Shared Infrastructure
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute Amendment I to Master Dual Jurisdiction Cooperative Agreement No. 20-028 with the City of Reedley for construction projects for repairs and/or improvements, and certain types of maintenance of public roads and associated facilities for which the City and County share jurisdictional responsibility, to extend the term by five years from January 1, 2026 to December 31, 2030 ($0).
REPORT
Approval of the recommended action will extend the Master Dual Jurisdiction Cooperative Agreement (Agreement) between the City of Reedley (City) and Fresno County (County) for dual jurisdiction transportation improvement and maintenance projects. Specific terms applicable to any particular project will continue to be established via a Project Specific Supplement Agreement (PSSA), which will be executed by the Director of the City of Reedley’s Department of Public Works and the County’s Director of Public Works and Planning. The authority to execute a PSSA applicable to each project was delegated to the County Director with the execution of the Agreement on January 7, 2020. This item is countywide.
ALTERNATIVE ACTION(S):
Your Board may choose to not approve the recommended action and the Agreement will expire. However, if the Agreement expires transportation improvement and maintenance projects for which the City and County share jurisdictional responsibility will require separate agreements to be approved by the Board of Supervisors.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action. The projects covered by the Amendment to the Agreement will be identified within each agency’s budgets and will follow each agency’s approval protocols. Sufficient appropriations and estimated revenues are included in the Department’s Roads Org 4510 FY 2025-26 Adopted Budget.
DISCUSSION-:
On January 7, 2020, the Board approved the Agreement with the City for transportation improvement and maintenance projects for which the City and County share jurisdictional responsibility. This Agreement framework allows PSSAs to be entered into for cooperative funding of maintenance or improvement projects along shared jurisdiction routes or crossing jurisdictional boundaries. This Agreement will expire on December 31, 2025, unless extended by mutual agreement between the City and County. The Amendment to the Agreement will extend the term for an additional period of five years, with an expiration date of December 31, 2030.
Although during the initial term of the Agreement, no joint jurisdiction projects were completed; it is in the best interest of both the City and County to maintain the Agreement in order to complete projects for which both are responsible in a timely fashion.
OTHER REVIEWING AGENCIES:
The Amendment to the Master Agreement was submitted by the City of Reedley and will be executed concurrently.
