SUBJECT:                     Fresno County Ordinance Code Amendment to Allow Compensation for In-Home Supportive Services Advisory Committee Members

 

RECOMMENDED ACTION(S):

TITLE

1.                     Conduct first hearing to amend the Fresno County Ordinance Code, Title 2, Chapter 2.80, Section 2.80.150 to allow the In-Home Supportive Services Advisory Committee members to receive compensation for attending monthly meetings to increase member participation; waive first reading of the Ordinance in its entirety; and set second hearing for March 5, 2024;

2.                     Designate County Counsel to prepare a fair and adequate summary of the proposed Ordinance; and

3.                     Direct the Clerk of the Board to post and publish the required summary in accordance with Government Code Section 25124(b)(1).

REPORT

The recommended actions conduct the first hearing to amend the Fresno County Ordinance Code Title 2, Chapter 2.80, Section 2.80.150 to allow In-Home Supportive Services (IHSS) Advisory Committee (AC) members to receive a $50 stipend for attending monthly meetings to encourage AC participation with no Net County Cost.  This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Your Board could elect not to pass the proposed ordinance amendment, in which case members would remain ineligible to receive compensation for participation on the IHSS AC.

 

FISCAL IMPACT:

 

There is no increase to Net County Cost (NCC) associated with the recommended actions. The Advisory Committees (AC) is a component of the In-Home Supportive Services (IHSS) Public Authorities (PA) allocation. The IHSS AC has been effectively operating within the designated fiscal allocation, and no County General Fund resources are utilized for the IHSS AC.

 

DISCUSSION:

 

The IHSS AC was created as mandated by Assembly Bill (AB) 1682.  On August 1, 2000, the Board approved the methodology for selection and recruitment of a nine member IHSS AC, consisting of five past or present consumers of the IHSS program, two past or present IHSS providers, and two other positions to be selected from community and professional consortium entities. The committee currently consists of one IHSS consumer, one IHSS provider, and two members that represent professional consortium entities. The committee has endeavored to increase membership over the years, but participation remains limited.

 

The Fresno County Ordinance Code currently states that AC members shall not be compensated except that they shall be reimbursed for reasonable expenses including, but not limited to travel, mileages, and childcare, for attending meetings and discharging other official responsibilities as provided by the Board of Supervisors in the Fresno County salary resolution.  The Department proposes amending the Ordinance Code to state that AC members shall be compensated through a stipend of $50 per session. Once the Ordinance Code is amended, the Advisory Committee may approve a revision to the bylaws during a regular meeting to allow for compensation. This amendment to the Ordinance Code will encourage participation and increase the number of committee members. This will also allow the committee to utilize available funding and reduce the chance of the State decreasing the annual allocation.

 

OTHER REVIEWING AGENCIES:

 

The IHSS AC has reviewed this Board Agenda Item and concurs with the recommended actions.
