SUBJECT:                     Agreement with Moore Twining Associates, Inc. for Analytical Water Testing Services for Special Districts Water and Wastewater Systems and the Juvenile Justice Campus

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute an Agreement with Moore Twining Associates, Inc. to provide analytical water and wastewater testing services for Special Districts and the Juvenile Justice Campus effective January 1, 2022, not to exceed five consecutive years, which includes a three-year base contract and two optional one-year extensions, total not to exceed $1,250,000.

REPORT

The Juvenile Justice Campus (JJC) is funded through the Fresno County Internal Services Department (FCISD).  Approval of the recommended action will allow Moore Twining Associates, Inc. to provide analytical water and wastewater testing services for water and wastewater systems in Special Districts and at the JJC.  This item pertains to locations in Districts 1, 4, and 5.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action.  If the recommended action is not approved, the water and wastewater systems operated by the County for Special Districts and JJC could face violations from the State Water Resources Control Board (State) for non-compliance in water and wastewater testing and reporting requirements.

 

FISCAL IMPACT:

 

There is no Net County Cost for the Special Districts.  The JJC is funded through the Fresno County Internal Services Department (FCISD).  All costs associated with this analytical water and wastewater tests are financed by the operations and maintenance budgets for each respective County Service Area or Waterworks District.  Funds for each district are generated through assessments, service charges, carryover funds and interest income.  All costs associated with the water and wastewater operations at JJC are paid from the County General Fund through FCISD.  The analytical water and wastewater testing services for the JJC is budgeted in Org 9140 and is reimbursed through the FCISD.  Sufficient appropriations and estimated revenues are included in various Department of Public Works and Planning- Special Districts Orgs FY 2021-22 Adopted Budgets and will be included in subsequent fiscal years during the term of the Agreement.

 

DISCUSSION:

 

The Public Works and Planning, Resources Division (Resources), through its Special Districts Section, provides for the operations and maintenance of twenty-one water systems and twelve wastewater treatment facilities.  The water systems and wastewater treatment facilities must comply with all requirements of California Code of Regulations (CCR), Title 22, related to laboratories providing analytical results for drinking water.  Drinking water testing results shall be transmitted to the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW), who will electronically submit the data to the California Laboratory Intake Portal (CLIP).  The testing results are electronically submitted into CLIP.  Wastewater testing results shall be transmitted to the California Regional Water Quality Control Board (CRWQCB), who will electronically submit the data to CLIP.  If the drinking water and wastewater water tests are not performed as mandated by the State, a Compliance Order will be issued, and fines and fees may be imposed due to non-compliance.  Exhibit A provides a map of each water and wastewater system operated by the County. 

 

A Request for Quotation (RFQ) was issued by Purchasing for analytical water and wastewater testing services on September 28, 2021.  The RFQ responses and two bids were received on October 27, 2021. 

 

After evaluation of the responses, the Department recommended to Purchasing that Moore Twining Associates, Inc. be awarded the Agreement as they were deemed the lowest responsive bidder.  Purchasing concurred with the recommendation to award the Agreement to Moore Twining Associates, Inc.

 

The recommended Agreement has a term of three years, with the option of two, one-year renewals upon written notice to the contractor by the Director of the Public Works and Planning Department, or his or her designee.  The Agreement also provides specific rates for analytical water and wastewater tests conducted for the various water and wastewater systems in Special Districts and JJC.

 

It is anticipated that more analytical testing services will be required over the term of this Agreement as capacities will be increasing at existing facilities such as County Service Area 34 and its Zones A, C and D (Brighton Crest, Bella Vista, Renaissance at Bella Vista respectively), and Waterworks District 41W and 41S (Shaver Lake).  From time to time, it is also anticipated that special testing will be required by the State and, at times, requested by the County.

 

The recommended Agreement has an annual limit of $250,000 per each possible year of the Agreement for a total maximum cost of $1,250,000 during the term.  Actual compensation will be based on fees for services at the rates detailed in Exhibit B of the Agreement.
