SUBJECT:                     Amendment of the Fresno County Ordinance Code to Modify the Section on Angle Parking-Restrictions

 

RECOMMENDED ACTION(S):

TITLE

1.                     Conduct first hearing to amend the Fresno County Ordinance Code, Chapter 11.16 Angle Parking Loading Zones, Section 11.16.010 Angle Parking-Restrictions, to reflect various changes to the Ordinance Code as a result of a recent traffic study; waive first reading of the Ordinance in its entirety; and set second hearing for May 7, 2024;

2.                     Designate County Counsel to prepare a fair and adequate summary of the proposed Ordinance; and

3.                     Direct the Clerk of the Board to post and publish the required summary in accordance with Government Code, Section 25124(b)(1).

REPORT

The recommended actions pertain to the installation of additional on-street angle parking stalls in the business district in the unincorporated community of Caruthers, located on Oak Street and on Tahoe Street.  This location has historically used angle parking on Oak Street and on Tahoe Street and due to the continued need by nearby businesses, additional on-street angle parking stalls is recommended.  This item pertains to locations in District 4.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the recommended actions, the Angle Parking-Restrictions section of the Fresno County Ordinance Code will remain unchanged. 

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions.  The estimated cost to install the additional angle parking stalls is $220 for materials and $1,325 for labor and equipment for a total estimated cost of $1,545.  Sufficient appropriations and estimated revenues are included in the Department of Public Works and Planning - Roads Org 4510 FY 2023-24 Adopted Budget.

 

DISCUSSION:

 

Section 22503 of the California Vehicle Code allows a local authority by ordinance to permit angle parking on any roadway.

 

Section 11.16.010 of the Fresno County Ordinance Code lists the designated angle parking locations and states, “No person shall angle park on any roadway or street or portions thereof unless official signs or markings designating such parking are in place.”  Vehicles parked at an angle, at locations not designated per Section 11.16.010, are subject to citation, per Section 11.16.500 Violation-Infraction.

 

It has been determined based on an engineering and traffic survey that existing on-street angle parking on Oak Street, and additional on-street angle parking on Tahoe Street, is needed by nearby businesses, and is reasonable and safe and will not significantly reduce traffic capacity on the roadway.

 

Department staff proposes changes to the Angle Parking-Restrictions section of the Ordinance Code to add the following four (4) locations:

 

1.                     East side of Oak Street from a point fifty feet north of Tahoe Street to a point one hundred forty feet north of Tahoe Street.

2.                     West side of Oak Street from a point fifty feet south of Tahoe Street to a point one hundred twenty feet south of Tahoe Street.

3.                     North side of Tahoe Street from a point seventy feet west of Pear Street to a point three hundred forty feet west of Pear Street.

4.                     South side of Tahoe Street from a point seventy feet west of Pear Street to a point three hundred forty feet west of Pear Street.

 

The Vicinity Map attached to this item shows the location of additional angled parking locations.

 

A notice that the Fresno County Angle Parking-Restrictions Ordinance is proposed for change will be published in the Fresno Business Journal before the second hearing on May 7, 2024. With your Board’s approval, the Ordinance amendment will take effect 30 days after it is adopted, and angle parking stalls will be installed shortly thereafter.

 

OTHER REVIEWING AGENCIES:

 

The California Highway Patrol (CHP) determined that they do not need to review the proposed ordinance amendment Section 11.16.010, but confirmed they enforce citations as noted in Section 11.16.500, as they provide traffic enforcement on Fresno County roads.
