SUBJECT: Amend the Bylaws of the Fresno County Behavioral Health Board
RECOMMENDED ACTION(S):
TITLE
Approve the amended Fresno County Behavioral Health Board Bylaws.
REPORT
There is no additional Net County Cost associated with the recommended action. With the passing of Proposition 1 (SB 326) local behavioral health boards are required to amend their bylaws in accordance with modifications to Welfare and Institutions Code 5604 and 5963.03 which regulate California Behavioral Health Boards Bylaws, Duties, Expenses, and Membership. On November 20, 2024 the Fresno County Behavioral Health Board (FCBHB) amended its bylaws by a unanimous vote of its members and is now seeking your Board’s approval. The terms of the bylaws require that your Board approve amendments to the bylaws. This item is countywide.
ALTERNATIVE ACTION(S):
If your board does not approve the amended bylaws, the FCBHB will not be in compliance with new legislation requirements for California Behavioral Health Boards.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action.
DISCUSSION:
On March 24, 2015, the Board adopted Resolution Number 15-080, consolidating the Fresno County Mental Health Board and Alcohol and Drug Advisory Board to create the FCBHB. The FCBHB is the public advisory board on adult, children’s, and justice system mental health and alcohol and substance use disorder (SUD) issues, whose duties and functions are delineated in the Welfare and Institutions Code (WIC) and the Health and Safety Code (HSC).
On October 13, 2015, the Board approved the bylaws of the newly formed FCBHB.
On December 18, 2018, the Board approved Amendment I to the FCBHB bylaws as described below:
• Reflected the exception that allows consumers to serve on the FCBHB in spite of their employment at a county mental health service, the California Department of Health Care Services, or a mental health contract agency,
• Define “recuse” to mean a member shall leave the room during a discussion or vote on any issue in which the member has a financial interest,
• Revise the bylaws to include descriptions of standing and ad hoc committees and their respective requirements per the Brown Act, and
• To indicate the date the bylaws were ratified and/or amended by the board.
With the passage of Proposition 1 (SB326/Behavioral Health Services Act (BHSA) in March 2024, Welfare and Institution Codes 5604 and 5963.03 that regulate California Behavioral Health Boards Bylaws, Duties, Expenses, and Membership has been amended to include requirements for youth membership and local education agency membership in California Behavioral Health Boards. This amendment also changes the verbiage used from “mental health” to “behavioral health” to include substance use disorder duties. The recommended action brings FCBHB into compliance with these new regulations. These changes are effective January 1, 2025.
