SUBMITTED BY:                     Margaret Mims, Sheriff-Coroner-Public Administrator

SUBJECT:                     Donation of Bullet-Proof Vests by the Sheriff’s Office to Advance Armenia Foundation

RECOMMENDED ACTION(S):

TITLE

Adopt resolution retroactively declaring certain expired bullet-proof vests surplus, and ratifying the donation of these bullet proof vests by the Sheriff’s Office to Advance Armenia Foundation, a 501(c)(3) foundation.

REPORT

There is no increase in Net County Cost associated with the recommended action. The recommended action will retroactively declare 291 expired bullet-proof vests, along with 80 ballistic and stab panels for the vests (Bullet-Proof Vests) surplus, and ratify the donation of the Bullet-Proof Vests by the Sheriff’s Office to Advance Armenia Foundation, a 501(c)(3) non-profit organization. This donation occurred in November 2020. These Bullet-Proof Vests were no longer usable by the Sheriff’s Office, due to the expiration dates of the Bullet-Proof Vests, but the recipient of the donation represented that they are still usable by the recipient to assist in law enforcement and field medical services in Armenia. This item is Countywide.

ALTERNATIVE ACTION(S):

There is no viable alternative action.

FISCAL IMPACT:

There is no increase in Net County Cost associated with the recommended action.  The value of each donated Bullet-Proof Vest was zero dollars ($0), as they were no longer usable by the County. These Bullet-Proof Vests have a life cycle of five (5) years. The donated Bullet-Proof Vests had a variety of expiration dates, but most are estimated to have expired around October of 2018.

DISCUSSION:

Government Code section 25372 provides that the Board of Supervisors may donate or lease any real or personal property that the Board declares to be surplus to any public agency or organization exempt from taxation, which includes “an organization exempt from taxation pursuant to Section 501(c)(3) of the Internal Revenue Code that is organized to provide health or human services.”

Advance Armenia Foundation (AAF) is an organization exempt from taxation pursuant to Section 501(c)(3) of the Internal Revenue Code that is organized to provide health or human services.  AAF represented that it will use the donated vests to assist in law enforcement and field medical services for Armenia.

In November of 2020, the Sheriff’s Office donated a total of 291 vests, along with 80 ballistic and stab panels for the vests. If the Bullet-Proof Vests had not been donated, they would have been scheduled for destruction. Sheriff’s Office staff removed all identifying badges or markings related to the Fresno County Sheriff’s Office from the Bullet-Proof Vests before they were donated.

Approval of the recommended action will retroactively declare these Bullet-Proof Vests surplus, and ratify the donation of the Bullet-Proof Vests to AAF.
