SUBJECT:                     Approve the selection through a Request for Proposal process of Clean Earth Environmental Solutions, Inc. to operate the Environmental Compliance Center and Related Household Hazardous Waste Programs for Fresno County and approve the subsequent Agreement with Clean Earth Environmental Solutions, Inc. to provide these services.

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute an agreement with Clean Earth Environmental Solutions, Inc. for overseeing the operation of the Environmental Compliance Center and related household hazardous waste programs effective February 1, 2023, not to exceed five consecutive years, which includes a three-year base contract and two optional one-year extensions, total not to exceed $7,500,000;

2.                     Authorize the Director of Public Works and Planning or his designee to execute the two optional one-year extensions and approve the use of funds designated for Additional Services and Contingencies.

REPORT

Approval of the recommended actions will allow the continued proper recycling and disposal of household hazardous waste (HHW) for County residents at the new Environmental Compliance Center (ECC) located at 310 South West Avenue, Fresno.  The recommended action will also allow for the consultant’s continued implementation of a variety of Local Network Programs that significantly increase public access to HHW disposal options.  This item is Countywide.

 

ALTERNATIVE ACTION(S):

 

Your Board may choose not to approve the recommended actions; however, the Department of Public Works and Planning (Department) would need to expend staff time to prepare another Request for Proposal (RFP).  This alternative action would require an extension of the current agreement as it expires January 31, 2023 and a lapse of contracted services cannot occur.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended actions.  Operation of the ECC facility and associated Local Network programs is fully funded by accumulated and current surcharge revenues on each ton of landfilled solid waste generated in the County.  The work associated with this agenda item is budgeted in the Public Works and Planning - Resources Org 9015 FY 2022-23 Adopted Budget and funded by the County’s Solid Waste Management Program surcharge fees.  Sufficient appropriations will be included in subsequent budget requests for the term’s duration.

 

DISCUSSION:

 

The proposed agreement represents the continuation of a more than 20-year process to comply with the Integrated Waste Management Act of 1989 (AB 939) requirements to provide local access to recycling and HHW management services/programs to the residents of the County.

On February 7, 2022, the Purchasing Division issued RFP No. 22-036 to solicit and select an experienced consultant to oversee the operations of the County’s ECC facility, implement various HHW-related programs, provide staffing, oversee the day-to-day operations/maintenance of one or more HHW facilities, meet Federal, State and County reporting protocols, and ensure proper disposal/recycling/placement of collected materials.  The consultant would serve for a period of three (3) years with the option of two (2) additional one-year term extensions.

 

Three bidders submitted responses by the March 7, 2022, RFP closing date.  A review committee consisting of Department staff as well as AB939 MOU Committee delegates representing the cities of Clovis, Fresno and several smaller jurisdictions, met with staff from the Purchasing Division to review and assess the proposals against selection criteria established in the RFP.

 

On June 14, 2022, based upon the recommendations of the review committee, the Purchasing Division issued a Tentative Award Notice, pending Board approval, to Clean Earth Environmental Solutions, Inc., the most responsive, responsible bidder whose proposal was determined to be most advantageous to the County.

 

By moving forward with this agreement, the residents of the County will have access to cost-effective, regional, HHW disposal options in the ECC which will be open to the public approximately 48 Saturdays out of the year with a possibility of more operating days per week if there is a substantial increase in program participation.  In addition, this will allow for the growing of Local Network collection sites, located throughout the County.
