SUBJECT:                     Amendment to Agreement with California Mental Health Services Authority

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute  Amendment No. 1 to Agreement with the California Mental Health Services Authority for the Evaluation of Prevention and Early Intervention Initiatives extending the term by one year and six months from January 1, 2022 to June 30, 2023 and increasing the maximum by $100,000 to a total of $633,010.

REPORT

Approval of the recommended action will allow the Department of Behavioral Health to continue evaluation of Prevention and Early Intervention programs, as well as implement corrective actions to increase data collection and monitoring as recommended by the project evaluator. California Mental Health Services Authority (CalMHSA) will act as a fiscal intermediary and provide program management and oversight for addition of the Multi-Agency Access Point (MAP) program to the Evaluation of Prevention and Early Intervention Initiatives. The recommended amendment will be funded with Mental Health Services Act (MHSA) Prevention and Early Intervention (PEI) and Innovation (INN) funds, with no increase in Net County Cost. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the recommended action, the Department would be unable to provide extensive support for improved data collection and monitoring activities and will face challenges in completing a timely evaluation of the MAP program.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The recommended amendment will extend the term by a year and a half and increase the maximum compensation from $533,010 to $633,010 to fund evaluation of the MAP program and evaluation of PEI programs with MHSA PEI and INN funds.  The cost is inclusive of the 9% administrative fee of total program funding due to CalMHSA. Sufficient appropriations and estimated revenues are included in the Department’s Org 5630 FY 2021-22 Adopted Budget and will be included in future budget requests for the duration of the contract.

 

DISCUSSION:

 

On September 14, 2010, the Board approved Agreement No. 10-489 with the CalMHSA authorizing the Department to join the CalMHSA Joint Powers Authority (JPA), to develop, implement, administer, and provide fiscal oversight of MHSA statewide projects.

 

On June 18, 2013, the Board approved Amendment No. 10-489-1 with CalMHSA, broadening the stated purpose for the JPA to allow CalMHSA to perform additional services for Behavioral Health Departments acting alone or in collaboration with other Departments, which includes but is not limited to, data management, research, and development.

 

On June 18, 2019, your Board approved the County’s MHSA FY 2018-2019 Annual Update, which included independent evaluators to provide evaluation of the Department’s PEI programs.

 

On May 26, 2020, your Board approved of Agreement No. 20-188 for CalMHSA to act as a fiscal intermediary and provide program management and oversight for the Evaluation of PEI Initiatives.  The agreement allowed for CalMHSA to contract with the RAND Corporation to evaluate the Department’s PEI programs.

 

Approval of the recommended action will allow for a one-year and six-month extension period and grant CalMHSA authority to continue contracting with the RAND Corporation for services on behalf of the County. RAND will continue to assist the Department with the evaluation of its PEI programs. The evaluation will ensure programs are addressing specific needs, goals, and outcomes, thus allowing for more effective monitoring, reporting, and evaluation of provided services. The recommended action will also expand evaluation to include the MAP program. The evaluation of services is organized into five tasks and will be completed by December 31, 2022.

 

The recommended agreement varies from standard County template as it was drafted by CalMHSA. The template is utilized by CalMHSA to execute participation agreements with different counties and is consistent statewide. Risk Management recommended the inclusion of standard County insurance requirements and indemnity language.  These were not incorporated as CalMHSA will include these provisions in its contract with the selected evaluator. The Department believes that the benefits of the recommended Agreement outweigh any potential risks and recommends approval of the agreement.  County Counsel reviewed and approved of the agreement. Either party may withdraw from the program upon a six-month written notice, or as deemed appropriate with prior written notice and the availability of funds. Upon cancellation, termination, or other conclusions of this contract, any County funds remaining undisbursed after CalMHSA satisfies all obligations arising from the administration of the program shall be returned to the County.
