SUBJECT:                     MOU with the Fresno County Superintendent of Schools

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a Joint Student Transition Planning Memorandum of Understanding with Fresno County Superintendent of Schools to establish formal policies and procedures for the transition of students from juvenile court schools to public schools, effective upon execution ($0).

REPORT

There is no Net County Cost associated with the recommended action.  The recommended Joint Student Transition Planning Memorandum of Understanding (MOU) will establish a formal collaboration and coordination process between the Fresno County Probation Department and the Fresno County Superintendent of Schools (FCSS) to provide for timely and smooth transition for students transferring out of juvenile court schools and into public school.  This item is countywide.

ALTERNATIVE ACTION(S):

Should your Board not approve the recommended MOU, FCSS may be deemed out of compliance with California Assembly Bill 2276, which requires a joint transition policy between the county office of education and county probation department and strongly encourages a Joint Transition Planning MOU formalizing that policy.

FISCAL IMPACT:

There is no Net County Cost associated with the recommended action as there is no cost associated with this MOU.

DISCUSSION:

In compliance with Assembly Bill 2276, the recommended MOU will formally establish policies and procedures to accomplish the following purposes: (1) collaborate with school districts and other local educational agencies in Fresno County to improve communication regarding dates of release and educational needs of students; (2) better coordinate immediate school placement and enrollment of students; and (3) ensure Probation officers have the information needed to support the return of students from juvenile court schools to public schools.  The MOU will also establish a formal process with the goal to allow for the immediate transfer of educational records for students transferring from juvenile court schools and create a uniform system for calculating and awarding course credits.

This MOU will become effective upon execution and will remain in effect until either party, with or without cause, provides a thirty day advance written notice to terminate.
