SUBJECT: Mod C Quarterly Governing Body Report
RECOMMENDED ACTION(S):
TITLE
Sitting as the Mod C Governing Body:
1. Receive and discuss the Fresno County Mod C Quarterly Report and updates for the period of September 13th, 2024, to December 13th, 2024;
2. Approve and authorize the Policy and Procedure Guides listed in Topic 1 of the Mod C Quarterly Report; and
3. Approve and authorize the Executive Director to submit an application for Transitional Shelter Care Facility Licensure for the new location at 3133 N. Millbrook Ave. Fresno, Ca 93703.
REPORT
There is no Net County Cost associated with the recommended actions, which will allow the Department of Social Services (Department) to submit the quarterly report to your Board, acting as the governing body of Mod C, in accordance with the Essential Terms of Agreement Between the California Department of Social Services and the County of Fresno (“Essential Terms of Agreement”) where the County agreed to the California Department of Social Services (CDSS) Transitional Shelter Care Facility (TrSCF) Operating Standards Chapter 12 Article 6 Section 86663. This provision requires that quarterly reports be submitted to the Mod C governing body by the Mod C Administrator. This item is countywide.
ALTERNATIVE ACTION(S):
There is no viable alternative action. Should the first and second recommended actions not be approved, the County will be out of compliance with the CDSS TrSCF Operating Standards Chapter 12 Article 6 Section 86663. Additionally, should the third recommended action not be approved, the Executive Director would be unable to request licensure thereby impacting timelines of future moves of Mod C.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended actions. Sufficient appropriations for the operational and administrative costs of Mod C are included in the Org 5610 FY 2024-25 Adopted Budget and will be included in future budget requests for the duration of the contract term.
DISCUSSION:
In accordance with the Essential Terms of Agreement where the County agreed to the CDSS TrSCF Operating Standards Chapter 12 Article 6 Section 86663, the facility’s governing body must conduct governing body meetings at least on a quarterly basis to review and discuss the operation and documents of the facility as specified in Health and Safety Code Section 1520.1(f), and based upon the review, ensure that the facility complies with all applicable regulations and operating standards:
Review and discussion of the facility’s operation shall include the incidents concerning a child in the facility involving contact with law enforcement that were reported to the Department as specified in Section 86661(p).
The first recommended action allows the governing body to receive and discuss the first quarterly report for Mod C. Per CDSS TrSCF Operating Standards Chapter 12 Article 6 Section 86661 (p). In addition to the reporting requirements of Sections 86661, 86662, 86665, and 86761, the licensee who operates a TrSCF shall notify CDSS by the end of CDSS’s next business day. In addition, a written report shall be submitted to CDSS within seven (7) days:
(A) Any person violates the personal rights of a child.
(B) A child is assaulted by another child or another person at the facility.
(C) A child is detained in a juvenile institution.
(D) A child requires physical health care in an acute care hospital or mental health services in an acute psychiatric hospital or community treatment facility.
Sections 86661, 86662, 86665, and 86761 of CDSS TrSCF Operating Standards Chapter 12 Article 6 requires the governing body of Mod C to review and discuss reports of: Death of any client from any cause; Death of any client as a result of injury, abuse, or other than natural causes, regardless of where the death occurred; Any complication to a medical condition or to an injury that existed prior to the client’s admission which requires medical treatment; Any injury to any client that occurs in the facility which requires medical treatment; Any unusual incident or client absence which threatens the physical or emotional health or safety of any client; Any suspected physical or psychological abuse of any client; Epidemic outbreaks; Poisonings; Catastrophes; Fires or explosions which occur in or on the premises; Manual restraints; Exceeding Capacity; Budget Overview; and Policy and Procedure Updates.
On February 6, 2024, the Board gave the Executive Director the authority to adopt intermediate Policies and Procedures affecting the County’s TrSCF Plan of Operation, with the understanding that the governing body would give final approval. Final approval from the Mod C governing body is required for the following Department Policy and Procedure Guides (PPGs): 03-16-01: Medication Oversight and Monitoring, 03-16-02: Runaway Plan, 03-16-03: Staffing and Personnel Requirements, 03-16-04: Youth Wellness Reports. The listed PPGs have completed the standard Department PPG approval process. The second recommended action requests final approval from the Mod C governing body for the PPGs to remain in effect.
On January 18, 2022, the Board of Supervisors approved and authorized the Interim Director of the Department to submit an application to CDSS, Community Care Licensing Division (CCL) for a Licensed TrSCF. In preparation for a possible move, on September 24, 2024, the Board of Supervisors approved an amendment to the lease agreement for the Heritage Centre to allow it to be used as the new location for the TrSCF. The movement of the current TrSCF, Mod C, would require the submittal of a new application to CDSS CCL. The third recommended action allows the Department’s Director to submit an application and all required paperwork to CDSS CCL to allow for Mod C to begin operating at the new location when it is available for use. The new application will be substantially the same as the application that was submitted for Mod C, except that the name and location will be updated.
