Recommended Action(s)
1. Adopt and authorize the Chairman to execute Resolution approving the Measure C Extension Local Transportation Program Funds Claim for FY 2024-25, authorize the Director of the Department of Public Works and Planning ("Director") or his designee to transmit a copy of the Resolution, if adopted, to the Fresno County Transportation Authority (FCTA), and authorize the Director to confirm the County's intent to complete reporting requirements for the prior year no later than November 15, 2024; and 2. Approve and authorize the Chairman to execute the six Measure C Extension Local Transportation Pass Through Revenues Certification and Claims for FY 2024-25, and certify that the funds will not substitute property tax funds, which were previously used for local transportation purposes ($9,492,967).

SUBJECT:                     Measure C Extension Local Transportation Program Funds Claims for FY 2024-25

 

RECOMMENDED ACTION(S):

TITLE

1.                     Adopt and authorize the Chairman to execute Resolution approving the Measure C Extension Local Transportation Program Funds Claim for FY 2024-25, authorize the Director of the Department of Public Works and Planning (“Director”) or his designee to transmit a copy of the Resolution, if adopted, to the Fresno County Transportation Authority (FCTA), and authorize the Director to confirm the County’s intent to complete reporting requirements for the prior year no later than November 15, 2024; and

 

2.                     Approve and authorize the Chairman to execute the six Measure C Extension Local Transportation Pass Through Revenues Certification and Claims for FY 2024-25, and certify that the funds will not substitute property tax funds, which were previously used for local transportation purposes ($9,492,967).

REPORT

Approval of the recommended actions will authorize submission of the Measure C Extension Local Transportation Program (LTP) Funds Claims to the Fresno County Transportation Authority (FCTA).  These are annual claims by the County for its Measure C Extension formula share of revenues dedicated to local transportation purposes.  There are separate claim forms for each of the six categories, including: street maintenance, Americans with Disabilities Act (ADA) compliance, flexible funding, pedestrian/trails - urban, pedestrian/trails - rural, and bicycle facilities.  This item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the recommended actions are not approved, the County will not receive its local transportation funding apportionments.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended actions.  The claims include the following FY 2024-25 County apportionments:

 

ADA Compliance                      $   152,058

Bicycle Facilities                      $   265,256

Flexible Funding                     $4,192,460

Pedestrian/Trails - Rural                     $   404,115

Pedestrian/Trails - Urban                      $   134,560

Street Maintenance                      $4,344,518

Total                      $9,492,967

 

Measure C Extension Local Transportation Funds ($9,492,967) are included in the Department of Public Works and Planning - Roads Org 4510 FY 2024-25 Proposed Budget.

 

DISCUSSION:

 

This is the eighteenth allocation to the County from the Measure C Extension Program that was approved by the voters in 2006.  Under apportionment guidelines, LTP funds are separated into six categories, each with its own apportionment formula determined by the FCTA.  The categories are street maintenance, ADA compliance, flexible funding, pedestrian/trails - urban, pedestrian/trails - rural, and bicycle facilities.  The FY 2024-25 allocations for each of the categories are shown in the attached Table 1.

 

In general, the allocations for street maintenance, ADA compliance, and flexible funding are based upon a 75% population - 25% road miles formula.  The bicycle facilities, pedestrian/trails - urban, and pedestrian/trails - rural allocations are based on population.  The total estimated amount of LTP funds to be apportioned to the County for FY 2024-25 is $9,492,967, a decrease of 2.12% ($9,698,613) from FY 2023-24.  A comparison of the amount apportioned by category to the County for FY 2024-25 and FY 2023-24 is shown in the attached Table 2.  The percentages are calculated based on a formula established by the Measure C Implementation Guidelines adopted by FCTA on June 12, 2024. For a detailed breakdown of the calculations please see the attached Table 3.

 

To ensure that LTP funds are spent for transportation purposes as intended by the voters, the Measure C extension legislation requires that the local agency claiming these funds certify that the local agency will not use the funds to replace property tax funds that are currently utilized to fund existing local transportation programs (California Public Utilities Code, section 142257). The proposed resolution will accompany the claims, and must state the local agency's intent to complete, no later than November 15, 2024, the reporting requirements regarding expenditures of FY 2024-25's Measure C dollars.

 

Measure C will expire in 2027 if not renewed by the voters. The County’s allocation is an important source of funding for neighborhood street maintenance, County wide street patching as a local match for federal and state funded projects. In FY 2022-23, Measure C funds were used toward pedestrian improvement projects in Calwa, Biola, West Park, Laton, Fancher Creek and Herndon-Barstow Elementary.
