SUBJECT:                     Retroactive Participation Agreement with California Mental Health Services Authority for Statewide Prevention and Early Intervention

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute a retroactive Participation Agreement with the California Mental Health Services Authority for Statewide Prevention and Early Intervention Program, effective July 1, 2021 through June 30, 2022, total not to exceed $342,413; and

 

2.                     Approve and authorize the Department of Behavioral Health Director, or designee, to be the signatory and act as the Fresno County representative on behalf of the Board of Supervisors on associated California Mental Health Services Authority Statewide Prevention and Early Intervention Program reports and forms, without modifying the maximum compensation.

REPORT

Approval of the recommended actions will assign funding to the California Mental Health Services Authority (CalMHSA) for FY 2021-22 to act as a fiscal intermediary, as well as direct and disseminate a Statewide Prevention and Early Intervention (PEI) Program. Approval of the recommended actions will authorize the Department of Behavioral Health Director to sign related reports and forms, without modifying the maximum compensation, and to act as a representative of the County. The services are funded with Mental Health Services Act (MHSA) - PEI funds, with no increase in Net County Cost.  This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the first recommended action, the Statewide PEI Program will not be provided to the County. The County would not receive any support to promote mental health and wellness, suicide prevention, and health equity to reduce the likelihood of mental illness, substance use, and suicide in the County from CalMHSA. If the second recommended action is not approved, the Department will return to your Board for all necessary reports and forms.

 

RETROACTIVE AGREEMENT:

 

The recommended agreement was received on May 24, 2021 and is retroactive to July 1, 2021. The delay in bringing the agreement before your Board on an earlier date was due to the Department’s extended review and CalMHSA’s review of recommended revisions.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions. Services are fully funded with MHSA-PEI funds. The County’s share of the cost will not exceed $342,413. The cost is inclusive of the 15% administrative fee of total program funding due to CalMHSA.  The other participating counties are paying their agreed upon share of cost directly to CalMHSA. Sufficient appropriations and estimated revenues are included in the Department’s Org 5630 FY 2021-22 Adopted Budget.

 

DISCUSSION:

 

On September 14, 2010, the Board executed Agreement No. 10-489 with CalMHSA, authorizing the Department to join the CalMHSA Joint Powers Authority (JPA), to develop, implement, administer, and provide fiscal oversight of MHSA projects.

 

On June 18, 2013, the Board approved Amendment No. 10-489-1 with CalMHSA, broadening the stated purpose for the JPA to allow CalMHSA to perform additional services for Behavioral Health Departments acting alone or in collaboration with other Departments, which includes but is not limited to data management, research, and development. Historically funds have been contributed to CalMHSA via the JPA but moving forward a Participation Agreement will be executed for the Department’s PEI contributions.

 

The recommended Participation Agreement will grant CalMHSA authority to develop and disseminate Statewide PEI project campaigns, programs, resources, and materials, provide subject matter expertise in suicide prevention and stigma and discrimination reduction (SDR) to support local PEI efforts, develop local and statewide capacity building support and new outreach materials for counties and community stakeholders. The primary focus of these programs is to promote mental health and wellness, suicide prevention, and health equity to reduce the likelihood of mental illness, substance use, and suicide among Californians, particularly among diverse and underserved communities.

 

The recommended agreement varies from the standard County template as it was drafted by CalMHSA. The template is utilized by CalMHSA to execute Participation Agreements with different counties and is consistent statewide. Human Resources - Risk Management recommended the inclusion of standard insurance requirements and indemnity language. These were not incorporated as CalMHSA will include these provisions in the request for proposal process for all Statewide PEI. The Department believes that the benefits of the recommended agreement outweigh any potential risks and recommends approval of the agreement. 

 

The recommended agreement is a one-year contract with the option for early termination in which either party may withdraw from the program upon a six-month written notice or extend as deemed appropriate with prior written notice and the availability of funds. Upon cancellation, termination or other conclusions of this contract, any County funds remaining undisbursed after CalMHSA satisfies all obligations arising from the administration of the program shall be returned to the County.
