RECOMMENDED ACTION(S):

TITLE

Approve Amendment to the Salary Resolution deleting twenty-one positions from the Sheriff-Coroner-Public Administrator’s Org 3111, effective June 29, 2020, as reflected in Appendix C.

REPORT

There is no increase in Net County Cost associated with the recommended action. Approval of the recommended action will delete the following twenty-one vacant positions from the Sheriff’s Court Services Unit (CSU): one Sheriff’s Sergeant, two Deputy Sheriff IV, ten Deputy Sheriff I/II/III, and eight Community Service Officers. The deletion of these vacant positions will reduce the staffing level in the Sheriff’s CSU to a level that can be supported by the Trial Court Security allocation. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, the Sheriff’s Office will not be able to maintain the 140 positions as outlined within the current Sheriff and Superior Court Memorandum of Understanding (MOU) as the Trial Court Security allocation is no longer sufficient to support the 140 positions.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. Deletion of these vacant positions is needed as Trial Court Security allocation funding is no longer able to sustain the costs associated with the Sheriff’s CSU current number of allocated positions. The estimated cost associated with the twenty-one positions will result in a decrease of $2,482,005 in salaries and benefits and anticipated revenues within the Sheriff’s CSU for FY 2020-21 and thereafter. Sufficient appropriations and estimated revenue reductions will be included in the FY 2020-21 Sheriff-Coroner-Public Administrator’s Org 3111 budget and in future requested budgets.

 

DISCUSSION:

 

In FY 2011-12, the California State Legislature enacted Assembly Bill (AB) 118, under Chapter 40, section GC 30029.05 to realign funding, including the Trial Court Security previously allocated by the State of California to the Judicial Branch, directly to the Counties. The same legislation requires each County Treasurer to establish a Trial Court Security Account for this purpose. Costs associated with providing security services to Fresno County Superior Court are offset by funding from this account.

 

On February 28, 2017, the Board approved a Memorandum of Understanding (MOU) with the Superior Court of California (Court) for court security services effective July 1, 2017 through June 30, 2022 with a total of 136 positions. On June 20, 2017, the Board approved 4 additional positions to bring the total to 140 positions. The current approved positions for the Sheriff’s CSU are as listed below.

 

    1 - Sheriff Lieutenant

    6 - Sheriff Sergeants

  95 - Deputy Sheriff I/II

    6 - Deputy Sheriff III

    7 - Deputy Sheriff IV

  20 - Community Service Officers

    3 - Communication Dispatchers

    1 - Account Clerk

    1 - Program Technician

140   Total Positions

 

The Trial Court Security allocation, as pursuant to Government Code section 30029.05 (b), to fund trial court security provided by County Sheriffs is no longer sufficient to fund the current 140 approved positions as outlined in the MOU.

 

The recommended action will allow the Sheriff’s Office to maintain the Court Services Budget within the available funds from the Trial Court Security allocation. Approval of the recommended action will reduce the staffing level to a practical overall total number of staff allocated to the CSU as listed below.
