SUBJECT: Memorandum of Understanding with the City of Fresno
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute a Memorandum of Understanding (MOU) between the City of Fresno (City) and County for repairs or improvements to the flooring areas of City Neighborhood Community Center, effective upon execution through October 31, 2026, total not to exceed $40,207.
REPORT
There is no Net County Cost (NCC) associated with the recommended action. Approval of the recommended action will allow the County and City to enter into an MOU agreement for repairs or improvements to the flooring areas of City Neighborhood Community Center, which are necessary. This item pertains to a location in District 3.
ALTERNATIVE ACTION(S):
Your Board may choose not to approve the recommended action. If not approved, the County will not complete the necessary repairs or improvements to the flooring areas of City Neighborhood Community Center.
FISCAL IMPACT:
There is no NCC associated with the recommended action. Sufficient appropriations for the necessary repairs or improvements totaling $40,207 are included in the Library Org 7511 FY 2025-26 Adopted Budget and is funded through Measure B library sales tax revenue.
DISCUSSION:
On October 09, 2007, the Board of Supervisors approved the County to enter into a Cooperation Agreement with the City effective June 30, 2007, to provide library services at City Neighborhood Community Centers. The Cooperation Agreement does not address the responsibility of repairs or improvements to the flooring areas of City Neighborhood Community Centers, which are currently necessary at the Ted C. Wills Center.
This MOU will establish a specific term, cost and timeline for a flooring replacement project at the Ted C. Wills Center; specifically, the Library desires to replace the carpet, as outlined in Exhibit A ( “Scope of Services”) of the MOU, for a total cost of $40,207, to be completed by no later than June 30, 2026. The existing carpet has reached the end of its useful life, and replacement is necessary to address wear and odors issues.
The Library has chosen not to use the standard Indemnification and Insurance language recommended by County Risk Department. The Library believes the language to be sufficient since the County will be hiring the contractor to perform the work. The County will provide insurance for the City for any work performed within the City’s facility. Additionally, the professional liability insurance will be waived as the City will not be providing professional or specialized services requiring such insurance coverage.
