RECOMMENDED ACTION(S):

TITLE

1.                     Approve Amendment to the Salary Resolution, Section 614.3 - Accrual for Prior Service, effective November 27, 2023, as reflected on Appendix “B”;

2.                     Approve Amendment to the Salary Resolution, adding Section 812.3 - Additional Compensation During an Emergency, effective November 27, 2023, as reflected on Appendix “B”.

REPORT

There is no Net County Cost associated with the recommended actions. Approval of the recommended actions will allow the Department of Human Resources to update the Fresno County Salary Resolution and remain competitive within the local labor market by expanding credit for prior service towards an employee’s Annual Leave accrual rate to all new and returning employees and providing compensation to exempt employees for working hours over schedule during an emergency.

 

ALTERNATIVE ACTION(S):

 

If your Board were not to approve the recommended actions, the Salary Resolution would remain unchanged.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended actions.

 

DISCUSSION:

 

On April 12, 2016, your Board approved an amendment to Salary Resolution, Section 614.3 - Accrual for Prior Service, authorizing employment with another public entity immediately preceding employment with the County to be credited for the purpose of determining the appropriate Annual Leave accrual rates for newly appointed department heads. Approval of the first recommended action expands verifiable prior service in one or more public agencies to be credited toward an employee’s Annual Leave accrual rate to all new or returning employees if such employment was terminated within ninety (90) days of the employee’s date of hire. Additionally, it would allow returning employees to be set at an annual leave accrual rate equivalent to that received during their previous employment tenure with the County.

 

Current employees will be notified by the Department of Human Resources regarding the process to receive credit for prior service and will have forty-five (45) days upon Board approval to submit the required form. All forms submitted during this time period, including those submitted by new and returning employees, will take effect January 22, 2024.

 

As directed by the County Administrative Officer (CAO), the second recommended action adds Salary Resolution Section 812.3 - Additional Compensation During an Emergency allowing the CAO to authorize in an emergency additional compensation for exempt employees not eligible for overtime for work performed in excess of over forty (40) hours in a workweek. The additional compensation would be paid at the employee’s base rate of pay; Department Heads and Elected Officials are excluded from receiving this compensation.
