SUBJECT:                     Retroactive Amendment to Agreement with Superior Court of California

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive first amendment to Agreement No. 23-357 with the Superior Court of California, County of Fresno (Court) to update references to the Court’s case management system (CMS) from Odyssey to e-Court and acknowledge the Court’s assignment of CMS services to e-Court, effective April 1, 2026, with no change to the term of August 1, 2023 to July 31, 2028, and no change to the maximum agreement amount of $600,000.

REPORT

There is no increase in Net County Cost (NCC) associated with the recommended action. The amendment is administrative in nature and updates the name of the Court’s CMS to reflect the Court’s transition to e-Court. All other terms and conditions of the Agreement remain unchanged. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative action. Failure to approve the recommended amendment would result in the Agreement referencing an outdated system and create administrative inconsistencies.

 

RETROACTIVE AGREEMENT:

 

The recommended amendment is retroactive to April 1, 2026, to align with the Court’s implementation of the e-Court CMS. The amendment is being brought to your Board in accordance with agenda processing timelines.

 

FISCAL IMPACT:

 

There is no increase in NCC associated with the recommended action. The amendment does not modify compensation, services levels or funding allocation under the Agreement.

 

DISCUSSION:

 

On July 18, 2023, your Board approved Agreement No. 23-357 with the Court for County department access to the Court’s CMS, automated door access, identification badges, Wi-Fi usage, and applicable printing services necessary to conduct County business within the Court facilities.

 

Effective April 1, 2026, the Court transitioned its CMS from Odyssey to e-Court. The recommended amendment updates the Agreement to reflect the Court’s current CMS platform. The amendment is administrative in nature and does not modify the scope of services, compensation, access levels, or other terms and conditions of the Agreement.

 

Approval of the recommended amendment will allow the Agreement to remain accurate and consistent with the Court’s current system platform while continuing uninterrupted access for County departments.
