SUBJECT: Designation of Applicant’s Agent Resolution Renewal
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Clerk of the Board of Supervisors to certify a California Office of Emergency Services Designation of Applicant’s Agent Resolution for Non-State Agencies.
REPORT
Approval of the recommended action will renew the Designation of Applicant’s Agent Resolution (Cal OES Form 130) which expires on October 10, 2026 for an additional three years, ensuring the County’s eligibility to receive future State and federal disaster assistance funds. This item is countywide.
ALTERNATIVE ACTION(S):
No viable options are available. Should your Board not approve the recommended action, the County will not be eligible to receive California Disaster Assistance Act (CDAA) grant funds and/or Federal Public Assistance (PA) grant funds for future State and/or federally declared disasters.
FISCAL IMPACT:
The recommended action will continue to allow the County to submit claims for reimbursement for State and federal disaster assistance grants.
DISCUSSION:
The California Office of Emergency Services (Cal OES) requires a current Cal OES Form 130 to be on file to obtain certain federal financial assistance under Public Law 93-288, as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, and/or State financial assistance under the California Disaster Assistance Act. A new Cal OES Form 130 is required when the previously approved resolution is more than three (3) years from the date of approval or when updates are needed to the name and/or title of authorized agents.
Although no gubernatorial or presidential disaster declarations have affected the County since that time, best practices recommend renewing this designation every three years to maintain eligibility for future disaster assistance. This Resolution is being brought forward to update and renew the County’s designation and ensure compliance with Cal OES requirements.
The proposed Resolution designates the County Administrative Officer, Director of Public Health as the Assistant Emergency Services Director, and the Auditor-Controller/Treasurer-Tax Collector to engage Cal OES for current and future disaster assistance grant applications. Further, it allows a minimum of three Governing Body Representatives to be listed. It is recommended that the Clerk of the Board certify the Resolution to avoid self-certification should a Board Member certify.
