DATE: June 4, 2024
TO: Board of Supervisors
SUBMITTED BY: Lisa A. Smittcamp, District Attorney
SUBJECT: Amendment I to Agreement with the California Victim Compensation Board
RECOMMENDED ACTION(S):
TITLE
1. Approve and authorize the Chairman to execute Amendment I to Agreement A-23-237 with the California Victim Compensation Board (CalVCB) for the Victim Restitution Program, amending the project representatives contact information, and allowing the District Attorney’s Office to modify the grant budget without a formal amendment, effective upon execution with no change in amount or term for the period ending June 30, 2026 ($269,109); and
2. Adopt a Resolution authorizing the Chairman to execute Amendment I to Grant Award Agreement, including any extensions or amendments, and approving and authorizing the District Attorney’s Office to modify the grant budget categories, subject to CalVCB’s approval, without formal amendment to the Grant Agreement, including: employee name, salary/hourly rate range, percentage of time spent on CalVCB matters, fringe benefits, and indirect costs (not to exceed 10% of salary), provided the total budget does not exceed $89,703 for each fiscal year, and provided the budget is not modified more than three times per fiscal year, except when necessitated by changes to employee names, for the period ending June 30, 2026 ($269,109).
REPORT
There is no increase in Net County Cost associated with the recommended action, which will amend the scope of work to allow the District Attorney’s Office (DA) to continue the Victim Restitution Program grant. The original grant agreement is for a three-year term, ending June 30, 2026, with a total grant award amount of $269,109. The recommended amendment I will amend the grant agreement to update the project representatives contact information and allow the DA to modify the grant budget without a formal amendment to the agreement. CalVCB requires a resolution for these proposed changes, so the second recommended action would adopt a resolution authorizing the Chairman to execute the amendment to the grant agreement to allow the DA to modify the grant budget. The Victim Restitution Program is a collaborative relationship between the District Attorney’s Office and the CalVCB and provides for the imposition of appropriate restitution orders on convicted offenders. This item is countywide.
ALTERNATIVE ACTION(S):
If the recommended amendment is not approved, this program scope of work will not be revised which will impact grant program operations through FY 2025-26.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended actions. The amendment will update the project representative information and allow the DA to modify the budget without a formal amendment to the agreement.
DISCUSSION:
On June 6, 2023, the County executed Board Agreement A-23-237 for a three-year grant agreement with CalVCB ending June 30, 2026, with a grant award amount of $269,109, which is being utilized to provide for the imposition of appropriate restitution orders on convicted offenders. The restitution is used to reimburse the CalVCB for the program payments it has paid out to victims of crime. This grant program has been in place since FY 1997-98 and has allowed the District Attorney’s Office to fund a Paralegal position to track cases and inform the prosecutor of the appropriate restitution upon conviction.
The recommended amendment I to the agreement amends the scope of work to update the project representatives contact information and allow the DA to modify the grant budget, subject to CalVCB’s approval, without a formal amendment to the agreement to reflect changes in the following categories: employee name(s), salary/hourly rate range, percentage of time spent on CalVCB matters, fringe benefits (including percentage of salary), and indirect costs (not to exceed 10% of salary), provided the total budget does not exceed the $89,703 for each fiscal year, and provided the budget is not modified more than three times per fiscal year, except when necessitated by changes to employee names. CalVCB requires a resolution in order to accept these changes and allow the DA to modify the grant budget.
