SUBJECT: Adopt Title VI Implementation Plan
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute Resolution adopting the Public Works and Planning Title VI Implementation Plan, in order for the County of Fresno to remain eligible for funding opportunities; and approve and authorize the Chairman to execute the Planning Title VI Implementation Plan.
REPORT
There is no Net County Cost associated with the recommended action. Approval of the recommended action will authorize the Chairman to execute a resolution adopting the Title VI Implementation Plan which ensures nondiscrimination in all of the Department of Public Works and Planning activities and programs and help maintain eligibility for future funding opportunities. This item is countywide.
ALTERNATIVE ACTION(S):
Your Board may choose not to approve the Title VI Plan, which may result in the Department remaining noncompliant or require staff to make changes to the plan. If the recommended action is not approved, any future grant applications would not be in compliance.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended action.
DISCUSSION:
Title VI of the Civil Rights Act of 1964 and related statutes prohibit discrimination on the basis of race, color, or national origin, sex, age, disability or socio-economic status in programs and activities receiving Federal financial assistance. Specifically, Title VI provides that "no person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance" (42 U.S.C. Section 2000d). The Department has a history of observing the mandates of Title VI through the use of best practices. This plan is intended to formalize those practices, along with some new provisions, to ensure full compliance with the Title VI mandate.
Recipients and subrecipients of United States Department of Transportation (USDOT) funding through the Federal Highway Administration (FHWA), and California Department of Transportation (Caltrans), are required to develop policies, programs, and practices that ensure Federal dollars are used in a manner that is nondiscriminatory as required under Title VI.
The Title VI Implementation Plan establishes procedures for supporting Title VI compliance, including public participation, language access, complaint procedures, monitoring, and annual reporting. The Plan also identifies Title VI Coordinator responsibilities and supports nondiscrimination in Department programs and activities.
The Department strives to ensure nondiscrimination in all of its activities and programs. Through a focused effort, the Department has made managers, supervisors, employees, contractors, and vendor sub-recipients of Federal-aid funds aware of and apply the intent of Title VI of the Civil Rights Act of 1964 and related statutes in performing assigned duties. Adoption and endorsement of the Title VI Plan would ensure that the County of Fresno remains eligible for future funding opportunities.
