SUBJECT: Retroactive Revenue Agreement with Children and Families Commission of Fresno County
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute a retroactive revenue Agreement with Children and Families Commission of Fresno County to implement the Help Me Grow system, effective July 1, 2016 through June 30, 2018 ($2,160,852).
REPORT
Approval of the recommended action will provide the Department of Public Health with two years of funding from the Children and Families Commission of Fresno County (First 5) to support the Help Me Grow (HMG) system, replacing the Screening, Decision-Making, Assessment, Referral and Treatment (SMART) Model of Care in the County. In addition, the recommended agreement will allow the County to draw down approximately $756,298 of Federal Financial Participation (FFP) over the two-year term. The pass-through First 5 and FFP funding will support the subcontract with Exceptional Parents Unlimited, Inc. (EPU) and indirect costs to implement the HMG system in the County, with no increase in Net County Cost.
ALTERNATIVE ACTION(S):
There are no viable alternatives. Should your Board not approve the recommended action, the Department would not be able to accept First 5 funds nor draw down Federal funding, which supports the integrated partnership of community agencies providing essential assessment, referral, and treatment services for children ages 0 to 5 in the County.
RETROACTIVE AGREEMENT:
The recommended retroactive revenue agreement is retroactive to July 1, 2016. The agreement was received from First 5 on October 7, 2016. The time required to prepare and review the recommended agreement did not allow presentation to your Board at an earlier date.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action. The maximum amount of the two-year revenue agreement is $1,404,554 or $702,277 annually. The recommended agreement will fund the subcontract with EPU and indirect costs to implement the HMG system in the County. The revenue agreement plus the FFP drawdown ($756,298) will provide a total funding amount of $2,160,852 over the two-year term. Sufficient appropriations and estimated revenues are included in the Department Org 5620 FY 2016-17 Adopted Budget and will be included in the FY 2017-18 budget request. The recommended Agreement allows indirect cost recovery at the Department’s full rate of 15.873 percent.
DISCUSSION:
On November 1, 2016, your Board approved Agreement No. 16-635 with Exceptional Parents Unlimited, Inc. (EPU) to implement the HMG system in the County, replacing the Screening, Decision-Making, Assessment, Referral and Treatment (SMART) Model of Care.
In order to maximize revenue, the recommended action will provide two years of pass-through Proposition 10: California Children and Families Act of 1998 funds from First 5 through the Department to EPU for the sole purpose of leveraging additional Federal Title XIX funds (FFP) into the County to support the implementation of the HMG system in the County. FFP allows funding for services that assist high-risk children on Medi-Cal or who are Medi-Cal eligible. The HMG system will continue developmental surveillance, response and follow up for young children and their families in need of early identification and intervention resources to achieve their full potential. The First 5 funds and additional leveraged FFP funds will support EPU and the HMG system in serving over 900 children and families each week.
With your Board’s approval, the Department will pass-through funding to ensure the First 5 funds can be used as a local match to leverage state and federal funds further supporting implementation and sustainability of the HMG System in the County. The recommended agreement contains a mutual hold harmless clause and an attorney’s fees clause favoring the prevailing party.
