SUBJECT:                     Adopt Resolution Authorizing the Payment of Common Area Maintenance Costs for Betty Rodriguez Library

 

RECOMMENDED ACTION(S):

TITLE

Adopt Resolution authorizing the County to pay its pro-rata share of Common Area Maintenance costs for the County’s Betty Rodriguez Library.

REPORT

There is no additional Net County Cost associated with the recommended action. Upon the purchase of the Betty Rodriguez Library (“Library”) in 2015, the County became responsible for a proportional share of 71.77% of the Common Area Maintenance (”CAM”) costs for the Cedar & Shields Shops Center (“Shopping Center”) it is situated in. The recommended action authorizes the County to pay for these maintenance costs. These costs have been paid through short-term purchase orders in the past.

ALTERNATIVE ACTION(S):

 

Your Board could direct the Department to pursue other more limited term solutions for paying these CAM fees.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions. Costs associated with the Department’s share of common area maintenance in the Shopping Center are included in the Library Org 75112006 FY 2023-24 Adopted Budget and will be included in subsequent fiscal year budget requests. The Department will pay its proportional share of 71.77% for common area maintenance in the Shopping Center.

 

DISCUSSION:

 

The Library is located in the Cedar and Shields Shops Center. The Cedar & Shields Shops Center is subdivided into three parcels, Parcel C, Parcel D, and Parcel E (collectively, “Parcels”), as depicted in Attachment A. Parcel C contains existing businesses. Parcel D is the existing Library. Parcel E is a former ice cream shop, which the County is proposing for acquisition, and is coming before your Board in a separate agenda item. All three Parcels have a recorded Declaration of Restrictions and Grant of Reciprocal Easements (“Declaration”) which establishes reciprocal parking access and common area maintenance fees for the benefit of the owners for shared parking, trash enclosures, street pole lighting, and other shared costs incurred by the center. These fees are allocated by the percentage of the building space owned by each parcel; the percentage for the Betty Rodriguez Library is 71.77%. The Declaration was recorded against the Property in February 2010, and has a full term of 50 years.

 

Approval of the recommended action will authorize County staff to pay the ongoing pro-rata share of the CAM fees for the Library (Parcel D). When the County originally purchased the Library in 2015, the County was unaware that the Library property was covered by the Declaration and has been paying the associated fees using Purchase Orders. While this is an acceptable solution, this recommended action will clearly authorize the Library to pay the fees for both parcels without any additional administrative burden. A separate resolution to address the costs associated with the proposed acquisition of the former ice cream shop (Parcel E) is coming before your Board in a separate agenda item.
