SUBJECT:                     State Local Fiscal Recovery Funds, Amendment to Scope of Work - Improvements to Tenaya Park

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve proposed amendment to the County of Fresno’s American Rescue Plan Act - State and Local Recovery Fund (ARPA-SLFRF) expenditure plan by amending the approved scope of work for improvements to Tenaya Park (County Service Area 2), which currently is limited to electrical lighting improvements, to include improvements to the recreation and park spaces in Tenaya Park, with no change to the approved allocation of $400,000. 

2.                     Approve and authorize Director of Public Works and Planning, or designee, to potentially use annual Job Order Contracts to perform the proposed project and other ARPA-SLFRF-funded park projects (improvements to various County parks, improvements to El Porvenir and Raisin City parks) authorized by your Board on December 13, 2022.

REPORT

Approval of the first recommended action will amend the County’s ARPA-SLFRF expenditure plan to include improvements to recreation and park spaces in County Service Area 2 (CSA 2), Tenaya Park, based upon District 2 meetings with community residents to request their participation and input to finalize a scope for the park improvements, with no change to the amount of funding requested.  Approval of the second recommended action will allow for the improvements at Tenaya Park and other park maintenance projects to potentially be performed using annual Job Order Contracting (JOC) as needed to complete projects.  This item pertains to a location in District 2.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the first recommended action, the scope of work for CSA 2 will be limited to the previously approved improvements to the electrical lighting system throughout Tenaya Park.  The Department would not have the ability to use the approved allocation to make improvements to the recreation and park spaces, as requested by the residents of CSA 2. Implementation of the park and recreation improvements would be delayed until another funding source becomes available to the Department.  If your Board does not approve the second recommended action, this project, and other ARPA-SLRF funded parks projects would need to be constructed using a method other than JOC.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended actions.  Sufficient appropriations and estimated revenues are included in the Department of Public Works and Planning - Org 8870 FY 2023-24 Adopted Budget to fund the implementation of the project. Costs for the recommended action will be reimbursed through Auditor-Controller/Treasurer-Tax Collector Org 1033 - Disaster Claiming, Fund 0026, Subclass 91021. 

 

DISCUSSION:

 

CSA 2 was formed on December 26, 1962, to provide services for the subdivision known as Tenaya Estates located West of Palm Avenue, and East of Fruit Avenue, in Fresno, CA.  The services consist of maintaining a two-and-a-half-acre community park, known as Tenaya Park, which is located in the center of the Tenaya Estates Subdivision, consisting of 142 residential parcels.  Tenaya Park provides recreational space to nearby residents and the public at-large due to its location within an unincorporated island that is surrounded by the City of Fresno.

 

On December 13, 2022, your Board approved the Department to use ARPA-SLFRF funding for needed improvements to the electrical lighting system throughout the park to improve public safety and provide a safer environment for visitors to utilize the park facilities for extended hours.  The project would have upgraded electrical conduit and wiring.  Since that time, CSA 2 proceeded with a project that replaced the current lighting with LED lighting, and this reduced electrical load reduced the need for the electrical conduit and wiring work.  While this work is still needed, the relative priority and urgency to the community was lessened, in favor of other types of upgrades to the park.

 

After recent discussions between District 2 staff and residents of CSA 2, County staff were given an updated priority list.  This list identifies additional park improvements beyond the originally approved park lighting improvements, and includes: adding a shade structure above the existing play structure, replacing the foam padding of the play structure, replacing bollards throughout the park, improvements to the irrigation system and pumps, replacing drinking fountains including adding pet-friendly drinking fountain/s, adding dog waste dispensers, updating signage such as parking areas, adding more garbage and recycling cans, and additional benches through the Tenaya Park.

 

Approval of the first recommended action will revise the existing scope of work for the Department’s Improvements to CSA 2 program to include the additional improvements to the recreation and park spaces at Tenaya Park to ensure that the park continues to provide recreation opportunities for the residents of CSA 2 and nearby residents of the County. If approved, the Department anticipates that SLFRF will be used to help fund as many of the residents’ priority level improvements as cost and budget allows. Based on cost estimate results, the Department anticipates using SLFRF for various improvements including, but not limited to, the items listed above.

 

Approval of the second recommended action will allow the Department to deliver this and several other ARPA-SLFRF-funded park projects (Improvements to Various County Parks, Improvements to El Porvenir and Raisin City Parks) authorized by your Board on December 13, 2022 using JOC, if necessary.  These projects were not included in the list of projects that might be performed using JOC, but the Department needs the flexibility of an additional construction method in order to deliver the projects and meet funding deadlines.

 

The recommended actions will permit the Department to use SLFRF under Category A, respond to the public health emergency or its negative economic impacts, by funding improvements to neighborhood features that promote health and safety and promote mental and physical wellness by encouraging residents and visitors to participate in outdoor recreational activities. The Department anticipates program implementation will be achieved through the use of supply contracts under the Purchasing Manager’s authority, and job order contracts already approved by your Board on February 6, 2024, to install as many of the improvements that will fit within the SLFRF allocation.
