SUBJECT:                     Department of Resources Recycling and Recovery Payment Programs Resolution

 

RECOMMENDED ACTION(S):

TITLE

Adopt proposed Payment Programs Resolution authorizing the submittal of individual or regional applications for various payment programs and specified Recycling Market Development Zone, Zone Incentive Fund related authority, administered by the Department of Resources Recycling and Recovery, for a period of five years from date of adoption of the Resolution; authorize the Chairman of the Board of Supervisors or his/her designee, as Signature Authority for all grant and payment program related documents necessary to secure funds and implement program activities; and authorize the Director of Public Works and Planning, or his/her designee, as Signature Authority for all grant-related documents, excepting only grant agreements and amendments thereto, necessary to secure funds and implement grant and payment program activities.

REPORT

The Department of Resources Recycling and Recovery (CalRecycle) program regulations require a jurisdiction’s governing body to authorize by resolution the application for and administration of grant and payment programs. The recommended action will update the County’s current payment program authorization to incorporate specified Recycling Market Development Zone, Zone Incentive Fund (RMDZ ZIF) related authority within the proposed revised Payment Programs Resolution. While the County’s previously approved grant resolution will remain active and unchanged. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Your Board may choose not to adopt the revised Payment Programs Resolution. Although the current Payment Resolution is active through 2028, without this authorization, the County would be unable to fully participate in certain CalRecycle payment programs and specified RMDZ ZIF-related activities addressed in the proposed Resolution.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the adoption of this resolution. The Department of Public Works and Planning has been awarded in excess of $4.8 million over the past 10-plus years.

 

DISCUSSION:

 

Staff recommends adoption of a revised resolution authorizing the County’s continued participation in payment programs administered by CalRecycle. These programs support activities including used oil and filter recycling, and beverage container recycling.

 

Over the past several years, the Board has adopted resolutions authorizing participation in various CalRecycle programs. These include:

 

                     Resolution 11-076 - Combined Tire Cleanup and Amnesty (TCA) Grant Program (adopted March 15, 2011 - expired January 31, 2013)

                     Resolution 12-078 - Waste Tire Amnesty and Waste Tire Cleanup Grant Programs (adopted February 21, 2012; effective February 1, 2013 - expired January 31, 2018)

                     Resolution 13-127 - Household Hazardous Waste (HHW) Grant Programs (adopted April 23, 2013 - expired April 22, 2018)

                     Resolution 15-067 - Used Oil and Filter Recycling Grant and Payment Programs (adopted March 10, 2015 - expired January 31, 2020)

                     Resolution 16-235 - City/County Payment Programs and Oil Payment Programs (adopted May 24, 2016 - expired May 23, 2021)

                     Resolution 21-168 and Resolution 21-169 - Allowed participation in CalRecycle grant and payment programs (adopted May 25, 2021 - expired August 8, 2023)

                     Resolution 23-267 and Resolution 23-268 - Continued participation in CalRecycle grant and payment programs (adopted August 8, 2023 - expires August 7, 2028)

 

On August 8, 2023, the Board adopted Resolution 23-267 which authorized the County’s participation in CalRecycle payment programs, and Resolution 23-268 which authorized the County’s participation in CalRecycle grant programs, respectively, for a period of 5 years from the date of adoption. This consolidated previous individual authorizations into a streamlined framework allowing the County to apply for multiple CalRecycle programs through two resolutions: one addressing competitive grant programs and one addressing payment programs allocated on a per capita basis.

 

Although Resolution 23-267 remains active staff recommends adoption of a revised Payment Programs Resolution at this time to incorporate specified RMDZ ZIF-related authority and associated signature provisions. The proposed resolution would supersede Resolution 23-267 and continue the County’s authority to apply for and participate in all eligible CalRecycle payment programs during the authorization period, reducing the need for separate Board actions as programs become available. The County’s separate Resolution 23-268 related to grant programs would remain in effect.

 

The proposed resolution would also allow the County to participate either independently or as part of a regional application with incorporated cities within the County. Adoption of the payment program resolution will also satisfy CalRecycle requirements for participation in the City/County Payment Program, which provides funding for beverage container recycling activities.
