SUBJECT:                     Department of Resources Recycling and Recovery Grant Program and Payment Program Resolutions

 

RECOMMENDED ACTION(S):

TITLE

1.                     Adopt proposed Payment Programs Resolution authorizing the submittal of individual or regional applications for various payment programs, administered by the Department of Resources Recycling and Recovery, for a period of five years from date of adoption of said Resolution and authorize Chairman of the Board of Supervisors and the Director of Public Works and Planning, or his/her designee, as Signature Authorities for all documents necessary to secure payment and implement payment program activities.

 

2.                     Adopt proposed Grant Programs Resolution authorizing the submittal of individual or regional applications for various grant programs, administered by the Department of Resources Recycling and Recovery, for a period of five years from date of adoption of said Resolution and authorize the Chairman of the Board of Supervisors or his/her designee, as Signature Authority for all grant-related documents necessary to secure grant funds and implement grant program activities.  Authorize the Director of Public Works and Planning, or his/her designee, as Signature Authority for all grant-related documents, excepting only grant agreements and amendments thereto, necessary to secure funds and implement grant program activities. 

REPORT

The Department of Resources Recycling and Recovery (CalRecycle) grant program and payment program regulations require a jurisdiction’s governing body to declare by resolution authorizations related to the application and administration of grant programs and payment programs.  The recommended actions will meet this requirement for each of the programs.  This item is countywide

 

ALTERNATIVE ACTION(S):

 

Your Board may choose not to adopt the Grant Program or Payment Program Resolutions. Doing so would make the County ineligible to receive any funds from CalRecycle for any of the grant programs or payment programs.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the adoption of these Resolutions.  The Department of Public Works and Planning has been awarded in excess of $4.3 million over the past ten years.

 

DISCUSSION:

 

Resolution 11-076 authorized participation in the combined Tire Cleanup and Amnesty (TCA) grant program (adopted on March 15, 2011 - expiration date of January 31, 2013).  However, in order to enable staff to address the separation of the Amnesty and Cleanup programs and to close out the combined TCA grant program cycle, Resolution 11-076 remained active while Resolution 12-078 was concurrently adopted and made effective on February 1, 2013. Resolution 12-078 authorized participation in all tire-related grant programs, including Waste Tire Amnesty and Waste Tire Cleanup (adopted on February 21, 2012; effective February 1, 2013 - expiration date of January 31, 2018).  Resolution 13-127 authorized participation in Household Hazardous Waste (HHW) grant programs (adopted on April 23, 2013 - expiration date of April 22, 2018).  Resolution 15-067 authorized the County’s participation in used oil and filter recycling grant programs and payment programs (adopted on March 10, 2015 - expiration date of January 31, 2020).  Resolution 16-235 authorized the County’s participation in payment program applications in individual and regional City/County payment programs and oil payment programs (adopted on May 24, 2016 - expiration date of May 23, 2021).

 

The revised recommended actions and associated resolutions, if approved would streamline the application process for current and future grant programs and payment programs by superseding all aforementioned resolutions, and incorporating these previous individual authorizations into two resolutions: one for CalRecycle grant programs, which are competitive in nature, and one for CalRecycle payment programs, which are awarded on a per capita basis. Each new resolution authorizes the County to apply for all grant programs and all payment programs for which the County is eligible.  Each resolution affords the County the option of participating in the various grant and payment programs as either an individual applicant, or a regional applicant in partnership with the various incorporated jurisdictions throughout the County.  Furthermore, by authorizing application and participation for all payment programs, the new payment programs resolution will allow the County to meet CalRecycle regulations requiring a resolution for participation in the City County Payment Program, which funds beverage container recycling activities.

 

The adoption of resolutions authorizing application for and participation in grant programs and payment programs have yielded in excess of $4.3 million in awarded funds over the past ten years, allowing the County to implement recycling and education programs that provide a significant benefit to County residents.
