SUBJECT:                     Amended and Restated Resolution for the Senate Bill 2 Permanent Local Housing Allocation Grant Application

 

RECOMMENDED ACTION(S):

TITLE

Adopt an Amended and Restated Resolution authorizing the Department of Public Works and Planning to submit the Permanent Local Housing Allocation Plan and a grant application to the California Department of Housing and Community Development for Senate Bill 2 Permanent Local Housing Allocation, which specifies that the use of the grant funds is for multi-family developments, the duration of the Allocation Plan is five-years, and that the public comment period was from May 22, 2020 to June 23, 2020.

REPORT

Approval of the recommend action amends and restates the resolution approved on June 23, 2020, to include further information required by the California Department of Housing and Community Development (HCD).  The resolution is amended to include that the Housing Allocation Plan is for a duration of five-years, that the funds will be utilized for the acquisition/rehabilitation and/or new construction of multi-family rental housing for households earning 80% of area median income (AMI), and restricting a minimum of 50% of the units to households earning no more than 60% AMI.  The recommended amended and restated resolution further adds that the public had the opportunity to comment on the Permanent Local Housing Allocation Plan item from May 22, 2020 to June 23, 2020, and that a Public Hearing was held on June 23, 2020 by your Board.  This is a countywide item.

 

ALTERNATIVE ACTION(S):

 

Your Board may choose not to approve the amended and restated resolution, and the grant application will be incomplete; the County will not receive the non-competitive grant funding to increase the production of affordable housing.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions.  The grant does not require a match or in-kind contribution, and will be used to assist the Department of Public Works and Planning (the Department) to increase the production of affordable housing throughout Fresno County. 

 

DISCUSSION:

 

On June 23, 2020, the Department brought an item to your Board to approve the application and resolution for the Senate Bill 2 Permanent Local Housing Allocation (PLHA) Grant.  Staff utilized the sample resolution provided by HCD without making any changes to the resolution.  After the resolution was adopted on June 23, 2020, staff contacted HCD staff, and was informed that a minor change to the resolution would meet the application requirements. 

 

On July 8, 2020, HCD provided a notice specifying a more significant change to the resolution was required, and giving local jurisdictions an additional 30 days to provide new or updated resolutions.  After this notice, staff requested written confirmation from HCD that the County’s resolution, approved by your Board on June 23, was sufficient.  HCD responded that the approved resolution was not detailed enough, and County would need to amend its resolution. 

 

Today’s item amends and restates the resolution to include the additional language required by HCD.  The recommended amended and restated resolution specifies that the PLHA Plan is a Five-Year Plan, that the Plan allocates annual funds to be utilized for the acquisition/rehabilitation and/or new construction of multi-family rental housing for households earning 80% of AMI, and restricts a minimum of 50% of the units to households earning no more than 60% AMI.  Additionally, the recommended amended and restated resolution specifies that the public had the opportunity to comment on the PLHA Plan from May 22, 2020 to June 23, 2020, when your Board held a Public Hearing on this matter.  All other terms in the amended and restated resolution remain unchanged.  Department staff sent the recommended amended and restated resolution to HCD, and received email confirmation from HCD staff that the recommended amended and restated resolution satisfies HCD’s requirements.

 

The deadline for the submission of the recommended amended and restated resolution to HCD is August 26, 2020.
