SUBJECT:                     Authorize Sole-Sourced Components for American Avenue Disposal Site Contract

 

RECOMMENDED ACTION(S):

TITLE

1.                     Make a finding as required by Public Contract Code Section 3400 that specification of certain products for the Supervisory Control and Data Acquisition (SCADA) system by brand or trade name for the leachate collection and control equipment at American Avenue Disposal Site (AADS) is compliant with the provisions of Public Contract Code Section 3400(c)(2) and 3400(c)(3); and

2.                     Authorize staff to incorporate these specific SCADA components within the existing project design which will be put out to bid.

REPORT

Approval of the recommended action would allow for standardize products for operational purposes at the American Avenue Disposal site (AADS).  The Supervisory Control and Data Acquisition components (SCADA components) are already in use at the site and specifying their continued usage for this upcoming excavation of Modules 9 and 10 will provide consistency to facilitate component interchangeability, operational efficiency, will minimize integration challenges and reduce potential construction and shut-down time.  The impact of this item is countywide.

 

ALTERNATIVE ACTION(S):

 

Declining to approve the recommended action will cause costly start-up and integration issues and add to construction and shut-down times at the site.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions.  The anticipated of costs for contract construction is $8,114,000 to $9,917,000.  The costs for the SCADA components are included in this estimate and are anticipated to total approximately $56,248.  Sufficient funding for the project is included in the FY 2023-24 Public Works and Planning, American Avenue Disposal Site (AADS) - Org 9026 budget.

 

DISCUSSION:

 

The AADS is a municipal solid waste disposal facility operating under a Solid Waste Facilities Permit issued by the Department of Public Health with the concurrence of the California Department of Resources, Recycling, and Recovery.  The AADS is located on American Avenue, approximately 17 miles southwest of the City of Fresno and approximately 6 miles southwest of the City of Kerman.  The site encompasses 440 acres, including 367 acres of permitted and available disposal area.

 

An upcoming project consists, in general, of the excavation of Modules 9 and 10, installation of a composite liner system consisting of geosynthetics over a geosynthetic clay liner, and the performance of a geoelectric leak detection survey. Plans and Specifications are being developed by Geologic and Associates.  Construction is anticipated to start in Spring of 2024 and be finished in Fall of 2024.  These components will be integrated into a public work, not acquired directly by County, and as such are governed by the Public Contract Code.

 

The Department requests that the Board make a finding under Public Contract Code Section 3400(c)(2) and 3400(c)(3) that a particular product may be designated by specific brand or trade name in order to match other products in use at AADS.  No similar or equivalent products are available which could be seamlessly integrated with the existing site components.  This finding will be described in the invitation for bid or request for proposals, pursuant to Public Contract Code Section 3400(c). 

 

After consideration of the application and installation requirements of the AADS project, it has been determined by the Department that the use of the SCADA components in this project are required for operational efficiency of AADS.  The products are already in use at the site and specifying their usage in this connected project will facilitate component interchangeability and will minimize integration challenges and reduce potential construction and shut-down times.  The SCADA components to be specified are listed as follows:

 

                     MOXA AWK-3121 US-T Ethernet Wi-Fi radio modem (for high temperature range)

                     WSDPT 3-5 surePump

                     Promag P 300 5P3B25-4RD5/0

                     Kayo 9 slot programmable logic controller (PLC), AutomationDirect D2-262 CPU, with H2-ECOM-100 Ethernet interface module and EA7-T6CL HMI display

 

The products will not be directly procured by the County but will be specified by make and model in the construction plans and specifications, to be acquired and installed as a part of the construction contract.
