SUBJECT: Amendment II to Agreement with OUTFRONT Media, LLC
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute Amendment II to Agreement A-22-058 with OUTFRONT Media, LLC for a Fentanyl Awareness advertising campaign, effective upon execution with no change in the term through March 6, 2025, amending the scope of services and increasing the maximum compensation amount by $160,000, to a total of $436,170.
REPORT
There is no increase in Net County Cost associated with the recommended action, which will increase the maximum compensation amount payable to OUTFRONT Media, LLC to allow the District Attorney’s Office (DA) and the County Administrative Office (CAO) to continue the Fentanyl Awareness advertising campaign throughout the County. The original Agreement was for a three-year term, through March 6, 2025, with two optional one-year extensions, and contained a maximum compensation not to exceed $156,170. On September 20, 2022, the Board approved Amendment I which amended the scope of services and increased the maximum compensation amount to $276,170. The recommended Amendment II will further amend the scope of services and increase the maximum compensation amount to $160,000 for the entire term, through March 6, 2027 (with two optional extensions), allowing the DA and the CAO to continue the Fentanyl Awareness advertising campaign. This item is countywide.
ALTERNATIVE ACTION(S):
If the recommended action is not approved, these professional services will not be provided to the DA and the CAO, which will impact the ability to get this vital public safety information out to the community.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action. The recommended Amendment II will amend the scope of services and increase the maximum compensation amount by $160,000 to a total of $436,170. Sufficient appropriations are included in the District Attorney’s FY 2023-24 Org 2860 Adopted Budget and in the CAO’s Local Innovation Fund Org 2540 FY 2023-24 Adopted Budget. Sufficient appropriations and estimated revenues for the optional term extensions will be included in subsequent budget requests for the District Attorney Org 2860 and the County Administrative Office Org 2540.
DISCUSSION:
On August 5, 2021, the County executed Purchasing agreement P-21-291 with OUTFRONT Media, LLC to provide a Fentanyl Awareness advertising campaign utilizing billboards and geofencing. The original Purchasing Agreement was for a seven-month term, ending March 5, 2022. On February 22, 2022, the County executed Board agreement A-22-058 (Agreement) for a three-year base contract with two optional one-year extensions and contained a maximum compensation not to exceed $156,170. On September 20, 2022, the Board approved Amendment I to the Agreement which amended the scope of services to provide for the advertising period from September 2022 through July 2023, and increased the maximum compensation by $120,000 to $276,170.
The recommended Amendment II to the Agreement further amends the scope of services to provide for the advertising period from November 2023 through March 2025, and increases the maximum compensation by $160,000 to $436,170, which will allow the DA and the CAO to continue the Fentanyl Awareness advertising campaign. The recommended amendment also corrects OUTFRONT Media, LLC’s corporate name, which was inconsistent in sections of the Agreement and Amendment I.
Fentanyl is a highly addictive respiratory sedative/pain killer with rates of overdose and deaths reaching epidemic levels in the United States. Our partnership with OUTFRONT Media, LLC has allowed us to reach all areas of Fresno County, through a campaign that is unique and heavily focused on out of the home advertising, billboards, digital, mobile ads, and social media platforms. The Departments believe this type of advertising continues to be effective in helping to educate the public about the dangers of Fentanyl use.
