SUBJECT: Appointment In Lieu of Election for Oro Loma Water District Board
RECOMMENDED ACTION(S):
TITLE
Consider and appoint Kyle Wilken to the Oro Loma Water District Board to a term effective December 5, 2025, and set to expire December 7, 2029.
REPORT
Approval of the recommended action will allow the Fresno County Board of Supervisors to appoint a District Board Member to the Oro Loma Water District (Oro Loma WD) Board. The Oro Loma WD is governed by the California Water Code and has a five-member board of directors, each director is elected to serve a four-year staggered term. This item pertains to a location in District 1.
ALTERNATIVE ACTION(S):
If the recommended action is not approved, a District Board Member position will remain vacant on the Oro Loma WD Board.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action.
DISCUSSION:
In accordance with California Elections Code Section 10515(b), the Board of Supervisors, as the supervising authority, shall appoint any person to the office who is qualified on the date when the election would have been held if no person has filed a declaration of candidacy for any office. The person appointed shall qualify and take office and serve exactly as if elected at a general district election for the office.
On August 29, 2025, the Clerk of the Board of Supervisors received a certification from Oro Loma WD indicating no individuals filed a declaration of candidacy for two offices of District Board Member, the terms for which are set to expire on December 5, 2025. One office is currently held by Brett Sloan, and the other was previously held by Donald Devine and is currently vacant.
On October 22, 2025, Oro Loma WD submitted an application for appointment from Kyle Wilken to the Clerk of the Board of Supervisors. Mr. Wilken’s application notes his interest in serving in the vacant seat previously held by Mr. Devine. Approval of the recommended action will appoint Mr. Wilken to the Oro Loma WD Board to a term effective December 5, 2025, and set to expire on December 7, 2029, filling a vacancy on the District Board.
