SUBJECT: Agreement with Tek84 Inc. for Compact Body Scanners
RECOMMENDED ACTION(S):
TITLE
1. Approve and authorize the Chairman to execute an Agreement with Tek84 Inc. to purchase three compact body scanners, one TekNET, software, and services for the Juvenile Justice Campus, effective upon execution, not to exceed five consecutive years, which includes a three-year base term and two optional one-year extensions, total not to exceed $550,034;
2. Adopt Budget Resolution increasing FY 2024-25 appropriations and estimated revenues for Probation Org 34409999 in the amount of $469,934, for the purchase of three body scanners and one TekNET (4/5 vote); and
3. Adopt Budget Resolution increasing the FY 2024-25 appropriations for the Juvenile Facility Grant fund 0075, Subclass 17306, Org 1146 in the amount of $319,968 (4/5 vote).
REPORT
There is no additional Net County Cost associated with the recommended actions. Approval of the first recommended action will allow the Probation Department (Department) to purchase compact body scanners and necessary software and maintenance services to enhance the security infrastructure at the Juvenile Justice Campus (JJC) and promote expansion of visitation, family engagement, and normative spaces. Tek84 Inc. was selected by the County of Orange, California (Orange County) following a competitive Invitation to Bid. The County of Fresno would utilize the cooperative clause in Orange County’s resulting agreement, in accordance with the County’s Purchasing Manual, which authorizes the County to “piggyback” off another governmental agency’s contract. Approval of the remaining recommended actions will establish appropriations and estimated revenues in FY 2024-25 to facilitate the purchase of body scanners, software, and services as fully funded by the Juvenile Facility Grant and Office of Youth and Community Restoration Least Restrictive Placement (OYCR LRP) Grant. This item affects District Four.
ALTERNATIVE ACTION(S):
Should your Board not approve the recommended actions, the goods and services would need to be bid by the County, causing a delay in the purchase and installation of the body scanners. Without the enhanced security screening provided by the body scanners, contraband that is not detectable by other means would continue to enter the JJC. These ongoing security concerns also delay the granting of furloughs and supporting less restrictive programming for youth detained in the JJC, as required under the OYCR LRP Grant funding.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended actions. The first recommended action will allow the purchase of goods and services from Tek84 Inc., which includes the initial compensation of $469,934 for FY 2024-25. Approval of the second and third recommended actions will increase appropriations and estimated revenues in Probation Org 34409999 and appropriations in Juvenile Facility Grant Org 1146. Sufficient appropriations and estimated revenues will be included in subsequent budget requests for the remainder of the agreement terms.
DISCUSSION:
Through the California State Budget Act of 2022 (AB 178), the Department received $3,454,699 in Juvenile Facility Grant funding, with a “focus on providing therapeutic, youth-centered, trauma-informed, and developmentally appropriate rehabilitative environments for youth, funding allocated from this item shall be used to modernize units and sleeping rooms; create more normative space; add treatment, vocational, educational, recreational, visitation, and family engagement space; and enhance security infrastructure to the extent it promotes creation or expansion of these specified spaces.”
On February 20, 2024, the Board approved a grant agreement with OYCR for the LRP Grant, covering the period of December 15, 2025, to December 31,2025. This funding supports the development and implementation of LRP settings in accordance with Welfare and Institution Code section 875(f)(1). On March 25, 2025, your Board approved the amendment to extend the grant’s termination date to December 31, 2027, and update OYCR contact information. This extension provides the Department with additional time to secure necessary agreements to meet the grant requirements, including obtaining OYCR approval for purchasing of one body scanner at JJC.
The Department has observed a rise in contraband entering the JJC that cannot be detected through standard search procedures or metal detectors. This ongoing security concern jeopardizes the safety of all individuals within the facility. Additionally, it disrupts the development and support of LRP settings and impedes Probation’s ability to maintain rehabilitative environments for detained youth at the JJC.
Pursuant to Chapter 4 of the County’s Purchasing Manual, the County is able to join other public entities in collectively preparing specifications, requesting and receiving quotations or proposals, and awarding to the lowest responsive, responsible bidder if the source selection method is otherwise in compliance with the requirements of the Purchasing Manual. Orange County issued an Invitation for Bids (IFB) in late 2023 for a compact body scanner. The IFB resulted in award to Tek84 Inc., with a five-year agreement executed on January 24, 2024. General Services Department - Purchasing Division reviewed this IFB and has determined that its procedures are consistent with the County’s RFP process. Tek84 Inc. manufactures high-technology security products for screening and surveillance, including a compact body scanner (Intercept) that detects both metallic and nonmetallic contraband. Orange County’s agreement included a cooperative contract clause, which allows the provision and pricing of the agreement to be extended to any county, municipal, or other non-profit or governmental organization.
The Information Technology Services Department has reviewed and approves of the information technology requirements and terminology as detailed in the Agreement.
Approval of the recommended agreement to purchase Tek84 Inc.’s Intercepts and services will allow Probation to enhance security measures at the JJC. This investment will help mitigate the issue of contraband entry, ensuring a safer environment for youth, families, staff, and contracted providers. The compensation for the five-year term is $550,034, which includes $469,934 for three compact body scanners, software, installation, training and two-year warranty, and $80,100 for three-year extended warranties on each of the compact body scanners.
The recommended Agreement includes a provision that requires Tek84 Inc. and the County of Fresno indemnify and hold Orange County harmless for liabilities arising from the County of Fresno’s use of the body scanners and services provided as a result of Orange County’s cooperative agreement. The Department has assessed this risk, and believes the benefits of entering into the recommended agreement outweigh the potential risks, as a prudent business consideration.
The Department has been actively working on research and development of policy and procedures pertaining to this item. Policy and procedures will be developed by the Department and vetted and approved by administration, County Counsel, and bargaining units. The compact body scanners will not be utilized until the approval and implementation of said policy and procedures, as well as training of operators.
