DATE: June 4, 2024
TO: Board of Supervisors
SUBMITTED BY: John Zanoni, Sheriff-Coroner-Public Administrator
SUBJECT: First Amendment to Agreement with Fresno Unified School District
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute a First Amendment to Agreement No. A-23-011 with Fresno Unified School District for law enforcement services to stipulate that the parties may agree to provide services at an alternate location for extended learning periods, with no change to the term of January 9, 2023 through June 30, 2025 with two optional one-year extensions, and no change to the Agreement maximum ($1,320,189).
REPORT
There is no additional Net County Cost associated with the recommended action. The Agreement, approved by your Board on January 3, 2023, allows the Sheriff’s Office to provide law enforcement services to Fresno Unified School District (FUSD), with the assignment of one Deputy Sheriff position during the school year and extended learning periods at Wawona Middle School. Approval of the recommended action will amend the Agreement to allow FUSD and the Sheriff’s Office to agree to an alternate location for Sheriff’s Office services provided during extending learning periods (the two (2) weeks of winter break in December and last three (3) weeks of summer break in June of every year). This item pertains to locations in District 2 and 3.
ALTERNATIVE ACTION(S):
If the recommended action is not approved, the Sheriff’s Office will not be able to provide law enforcement services at temporary locations for extending learning.
FISCAL IMPACT:
There is no additional Net County Cost associated with this action. The recommended action will amend the Agreement to allow FUSD and the Sheriff’s Office to mutually agree to change the location for the Sheriff’s Office to provide law enforcement services for this revenue agreement for extending learning periods. There will be no change for 1,700 hours of each school year, which includes extending learning for two weeks in December during winter break and the last three weeks in June.
On November 28, 2023, your Board approved the amendment to the Master Schedule of Fees (MSF) rates as recommended with the decrease of one percent (1%) since FY 2022-23, from $136.12 for Deputy III regular hourly rate to $135.04 and from $73.17 to $76.58 for overtime hourly rate.
The Agreement allows for Special Events services at the request of the FUSD at the overtime hour rate of a Deputy Sheriff III.
Sufficient appropriations and estimated revenues for Sheriff-Coroner-Public Administrator’s Org 3111 will be included in future budget requests.
DISCUSSION:
On January 3, 2023, your Board approved Agreement No. A-23-011 with FUSD to add back law enforcement services at Wawona Middle School through the Sheriff’s Office. Prior to this agreement, on February 4, 2020, your Board approved an agreement to provide law enforcement services to the FUSD with the assignment of one Deputy Sheriff position during the school year, August 12, 2019 through June 30, 2020. Duties included intervention, prevention, education and enforcement activities at Wawona Middle School.
FUSD has informed the Sheriff’s Office that this summer, Wawona Middle School is hosting its summer school at an alternate location, at Bullard Talent K-9 School. FUSD would like to amend the agreement to provide flexibility for the location of services for this extended learning period and future extended learning periods.
Approval of the recommended action will amend the agreement to allow the Sheriff’s Office to provide law enforcement services to FUSD for extended learning services at a location other than the Wawona Middle School campus during the last three (3) weeks of June and two weeks in December.
