RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive First Amendment to Agreement No. 25-122 with the City of Fresno to continue to assign five sworn Police Officers, one sworn Police Sergeant, and one Crime Analyst to the Public Safety Realignment Adult Compliance Team and Multi-Agency Gang Enforcement Consortium Team, effective July 1, 2025, with no change to the Agreement term of July 1, 2024 through June 30, 2029, and increasing the Agreement maximum by $1,992,584 to a total of $3,932,659.

REPORT

The City of Fresno will continue to provide three sworn Police Officers and one Crime Analyst to the Multi-Agency Gang Enforcement Consortium Team (MAGEC), and two sworn Police Officers and one Police Sergeant to participate as members of the Public Safety Realignment Act (Assembly Bill 109) Adult Compliance Team (ACT). The Agreement requires annual budget approval from the Community Corrections Partnership (CCP) executive committee to ensure continued funding. Therefore, an item will be brought before the Board each year for final approval to ensure the necessary funds are allocated. Although the recommended Amendment is with the City of Fresno, which is in District three, this item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, the ACT and MAGEC will not include five sworn Police Officers, one sworn Police Sargeant, and one Crime Analyst from the City of Fresno.

 

RETROACTIVE AGREEMENT:

 

The recommended Amendment is retroactive to July 1, 2025 due to waiting for your Board’s approval of the County’s FY 2025-26 budget on September 15, 2025 to ensure availability of funds. Additional time was required to prepare the recommended agreement to have it reviewed and approved by the City of Fresno. The City of Fresno executed the recommended Amendment on January 22, 2026, and is being brought before your Board on the first available date within the agenda item processing deadline.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. The amount of $1,992,584 for the recommended Amendment is fully funded with AB 109 funds received from the State of California. Sufficient appropriations and estimated revenues for these services are included in Probation’s FY 2025-26 Adopted Budget for Org 3430. There are pending invoices for the recommended agreement in the total amount of $446,912.

 

DISCUSSION:

 

The Adult Compliance Team (ACT) is a multi-agency unit created under Assembly Bill (AB) 109 to enhance supervision and public safety addressing public safety concerns and issues facing local law enforcement in Fresno County. The ACT enforces conditions of probation, conducts compliance and non-compliance searches of AB 109 probationers who are under the supervision of the Fresno County Probation Department, and provides immediate response to crisis situations. The teams also provide surveillance and warrant sweeps in conjunction with other law enforcement agencies.

 

On April 8, 2025, your Board approved the most recent agreement with the City of Fresno for the assignment of three sworn Police Officers and one Crime Analyst to the MAGEC, and two sworn Police Officers and one Police Sergeant to the ACT in the amount of $1,940,075 for the first year of the term, from July 1, 2024 through June 30, 2025. Because the agreement requires annual budget approval, an amendment must be brought forward each fiscal year to update the approved amount.

 

On June 9, 2025, the CCP Executive Committee approved the City of Fresno’s budget for its continued participation in the ACT and MAGEC. This allocation was included in the Department’s budget, which your Board approved on September 15, 2025, increasing the agreement by $1,992,584, for a new agreement total of $3,932,659.
