SUBJECT:                     First Amendment to Agreement with Clean Earth Environmental Solutions, Inc.

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize Chairman to execute a First Amendment to Agreement No. A-23-043 with Clean Earth Environmental Solutions, Inc. to revise the Household Hazardous Waste Operator’s Compensation to include the mobile collection program costs for Clean Earth Environmental Solutions, Inc. to provide services at the Local HHW Network Temporary Event Collection Programs, with no change in term and no additional compensation added to the Agreement ($7,500,000).

REPORT

Approval of the recommended action allows the Clean Earth Environmental Solutions, Inc. (Consultant) to provide household hazardous waste (HHW) collection and transportation services at Local HHW Network Temporary Event Collection Programs at the cost quoted in the Consultant’s response to the Request for Proposal 22-036 (“RFP”).  The service rates for mobile collection for the Local HHW Network Temporary Event Collection Programs are indicated in the recommended Amendment to Exhibit B of Agreement No. A-23-243.  In transferring pricing information from the Consultant’s response to the RFP to Exhibit B of the Agreement, the mobile collection program costs chart was accidentally omitted.  This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Your Board may deny the recommended action; however, this may result in a disruption of services and inconvenience to the County, as this Consultant will then be unable to provide services at Local HHW Network Temporary Event Collection Programs.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action.  Operation of the HHW facility and associated Local Network Programs, such as the sharps, bulbs and battery drop-off locations and Temporary HHW Collection Events throughout Fresno County and its jurisdictions, are fully funded by accumulated and current surcharge revenues on each ton of landfilled solid waste generated in Fresno County.  Sufficient appropriations have been included in the FY 2023-24 Adopted Budget for the Public Works and Planning Resources Org 9015 and will be included in subsequent budget requests.

 

DISCUSSION:

 

On January 24, 2023, the County entered into Agreement A-23-043 with the Consultant to provide Household Hazardous Waste Program Operations Services for a term of three years, with the option of two one-year extensions.  Consultant serves as the County’s Regional HHW Facility Manager, implements various HHW-related programs, provides staffing, oversees the day-to-day operations/maintenance of one or more HHW facilities, meets Federal, State, and County reporting protocols, and ensures proper transport/disposal/recycling/placement of collected materials.  In addition to providing for operations at the HHW facility, the Consultant provides staffing and operations for the HHW Local Network, Door-to-Door and Temporary One-Day Collection Events.

 

When the Agreement was drafted, the mobile collection program costs chart from the Consultant’s response to the RFP to Exhibit B of the Agreement was accidentally omitted.  This chart contains Consultant’s rates for providing equipment and staff for each 200-resident mobile collections event, as well as solid waste collection and disposal at each mobile event.
