SUBJECT:                     Local Incarcerated Persons Retroactive Revenue Agreement with the City of Fresno

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a Retroactive Revenue Agreement with the City of Fresno for the housing of local incarcerated persons effective July 1, 2024, not to exceed three consecutive years, total not to exceed $542,025.

REPORT

There is no additional Net County Cost associated with this action. The City of Fresno, through the Fresno Police Department (City), has requested the continuation of an agreement to designate the housing of three local incarcerated persons that may be arrested by the Fresno Police Department. The rate under the Agreement is $165 per bed, per day, and is a firm-fixed, per-diem rate for services that is not subject to adjustment during the time period of this Agreement. This rate will recover the full cost according to the FY 2024-25 daily jail cost study. The Agreement also provides for reimbursement for County guards in the event one of the local incarcerated persons using these beds must be transported to an outside medical facility, which will be billed separately,  based on the Master Schedule of Fees approved at the time. The current per diem rate for FY 2023-24 is $60.28 per hour, per guard, for those local incarcerated persons seeking medical care from an outside medical facility, which is consistent with the rate charged to the United States Marshal for federal inmates. The per hour rate for the Correctional Officer position is consistent with the Master Schedule of Fees (MSF) hourly rate approved by your Board on November 28, 2023. This item is countywide.

ALTERNATIVE ACTION(S):

If the recommended agreement is not approved, the Sheriff’s Office will not reserve the three housing beds for City arrestees.

RETROACTIVE AGREEMENT:

The recommended action is retroactive to July 1, 2024 due to the length of time required for negotiation and approval of the recommended agreement. The signed agreement was sent to the Sheriff’s Office by the City on July 8, 2024.

FISCAL IMPACT:

There is no increase in Net County Cost associated with the recommended action. The estimated revenues in the amount of $180,675 have been included in the Recommended FY 2024-25 Budget for the Sheriff-Coroner-Public Administrator Org 3111.

This revenue agreement will be for three consecutive years with no change to the maximum compensation of $542,025 and it will be as follows:

•                     Year 1 FY 2024-25 (July 1, 2024 - June 30, 2025) $180,675 ($165 rate)

•                     Year 2 FY 2025-26 (July 1, 2025 - June 30, 2026) $180,675 ($165 rate)

•                     Year 3 FY 2026-27 (July 1, 2026 - June 30, 2027) $180,675 ($165 rate)

DISCUSSION:

Since November 2013, the City has had an agreement with the County of Fresno to designate the housing of five pre-trial local incarcerated persons that may be arrested by the Fresno Police Department. The City is decreasing the number of beds from 5 beds to 3 beds and will continue to be responsible for providing information in regard to which three pre-trial incarcerated persons will be housed under the recommended agreement to the Sheriff’s Office Jail Watch Commander.

The rate under the proposed agreement is $165.00 per day, per bed, and is a firm-fixed, per-diem rate for services that is not subject to adjustment during the time period of the recommended agreement.

The approval of the recommended action also provides for reimbursement of $60.28 per hour for FY 2024-25, per guard for local incarcerated persons seeking medical care from an outside medical facility. The recommended agreement continues these services for up to three years.
