SUBJECT:                     Retroactive Agreement with Central Unified School District for Law Enforcement                      Services

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute retroactive Agreement with the Central Unified School District for law enforcement services effective August 9, 2017 through June 7, 2018 ($147,727); and

2.                     Adopt Budget Resolution increasing FY 2017-18 appropriations and estimated revenues for Sheriff-Coroner Org 3111 in the amount of $8,364 (4/5 vote).

REPORT

There is no additional Net County Cost associated with these actions. Approval of the recommended actions will provide continuation of law enforcement services to the Central Unified School District with the assignment of one Deputy Sheriff position during the school year. This item pertains to a location in District 3.

 

ALTERNATIVE ACTION(S):

 

If your Board does not approve the recommended actions, the Sheriff-Coroner’s Office would be required to discontinue providing these specified services to the Central Unified School District due to loss of funding and the subsequent elimination of one Deputy Sheriff position.

 

RETROACTIVE AGREEMENT:

 

This recommended agreement is retroactive due to Master Schedule of Fees (MSF) rates being approved and adopted by your Board on October 31, 2017, after the school year started for Central Unified School District. The signed agreement was received from Central Unified School District on December 22, 2017.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with these actions, which will provide $147,727 in revenue from the Central Unified School District for services provided by one Deputy Sheriff for up to 1,440 hours.

 

The amount of $55,745 will be provided in revenue for up to 576 hours at $96.78 per hour from August 9, 2017 through November 30, 2017 (based on the FY 2016-17 rates as approved by your Board on May 24, 2016).  The amount of $91,981 will be provided in revenue for up to 864 hours at $106.46 per hour from December 1, 2017 through June 7, 2018 (based on the new MSF rates approved and adopted by your Board on October 31, 2017 effective December 1, 2017).

 

Appropriations and revenues in the amount of $139,363 are included in the FY 2017-18 Sheriff-Coroner’s Org 3111 Adopted Budget and were based on the amount of the prior year agreement with Central Unified School District. The second recommended action will increase the appropriations and estimated revenues by $8,364 in Sheriff-Coroner’s Org 3111 for FY 2017-18 to account for the increase in the MSF rates effective December 1, 2017 for Deputy Sheriff services.

 

DISCUSSION:

 

The Sheriff-Coroner’s Office has provided contracted law enforcement service to the Central Unified School District since 2004. Duties performed included intervention, prevention, education, and enforcement activities at the Central High School West Campus.

 

On August 9, 2016, your Board approved the first amendment to Agt. #15-373 to provide law enforcement services to the Central Unified School District with the assignment of one Deputy Sheriff position during the school year effective from August 9, 2016 through June 7, 2017. The proposed agreement for law enforcement services is for the time period of August 9, 2017 through June 7, 2018 and updates the rates as discussed earlier.

 

Additionally, at the request of the school and upon agreement of both parties, the Sheriff-Coroner shall provide law enforcement services at the school’s special events at the Deputy Sheriff overtime rate of $54.94 per hour for the period of August 9, 2017 through November 30, 2017 based on FY 2016-17 rates (approved by your Board on May 24, 2016) and $60.43 per hour for the period of December 1, 2017 through June 7, 2018 based on the new MSF rates (approved and adopted by your Board on October 31, 2017 effective December 1, 2017).
