SUBJECT:                     Retroactive Amendment I to Agreement with Fresno County Superintendent of Schools and the Resiliency Center of Fresno - Handle with Care Plus

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive Amendment I to Agreement with the Fresno County Superintendent of Schools and the Fresno Police Chaplaincy Resiliency Center, to revise the name from Fresno Police Chaplaincy Resiliency Center to the Resiliency Center of Fresno as identified on their legal documents, with no change to the term of September 21, 2021 through June 30, 2024, or compensation maximum of $1,061,460.

REPORT

Approval of the recommended action will correct the Resiliency Center of Fresno’s (Center) name on the agreement. The name was erroneous and does not exist as a legal entity; therefore, the Department of Behavioral Health is unable to reimburse for services provided. The agreement terms and conditions remain unchanged. This item pertains to locations in Districts 2 and 3.

 

ALTERNATIVE ACTION(S):

 

There are no viable alternative actions. Should your Board not approve the recommended action, the Department will not be able to reimburse the provider for services rendered to youth and families, disrupting the approved Mental Health Services Act Innovations (MHSA-INN) project.

 

RETROACTIVE AMENDMENT:

 

The recommended amendment is retroactive to September 21, 2021, as the Department was notified on November 18, 2021 that the Center’s legal name until after the agreement was executed.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The maximum compensation for the recommended amendment remains unchanged at $1,061,460 for the term and will be financed with MHSA-INN funds. Costs will not exceed $341,539 for FY 2021-22.  Sufficient appropriations and estimated revenues are included in the Department’s Org 5630 FY 2021-22 Adopted Budget and will be included in future budget requests for the duration of the contract.

 

DISCUSSION:

 

The MHSA-INN component provides California counties the opportunity to develop and test new unproven mental health models with the potential to become tomorrow’s best practices. The primary purpose of INN projects is to achieve an increase to access, quality, interagency and community collaborations related to mental health services or supports or outcomes.

 

On September 21, 2021, your Board approved Agreement No. 21-377 with Fresno County Superintendent of Schools (FCSS) and Resiliency Center of Fresno to implement the Handle with Care Plus INN plan approved by your Board and the MHSOAC.

 

On November 18, 2021, the Department learned that the name was erroneous, and the provider would not be able to be reimbursed for services provided.

 

Approval of the recommended amendment will correct the name on the agreement to align with the Center’s legal entity name, Resiliency Center of Fresno, as approved by the Department of the Treasury Internal Revenue Service Tax Exempt and Government Entities Division and allow for the Department to reimburse the Center for the services provided and for the term of the contract.

 

The recommended amendment remains a three-year contract with FCSS and the Resiliency Center of Fresno from September 21, 2021 to June 30, 2024. The agreement terms and conditions remain unchanged .

 

OTHER REVIEWING AGENCIES:

 

The Behavioral Health Board has reviewed and approved the INN plan for Handle with Care Plus on April 9, 2020.
