SUBJECT:                     First Amendment to Master Agreement for Emergency Response and Supplemental Plumbing Services

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute First Amendment to Master Agreement No. A-23-536 for emergency response and supplemental plumbing services, increasing the maximum compensation by $1,000,000 to a total of $2,000,000, with no change to the potential five-year term of October 10, 2023 through October 9, 2028 (4/5 vote).

REPORT

There is no Net County Cost associated with the recommended action, which will approve an amendment to the current Master Agreement with A Reliable Plumbing, LLC (Reliable Plumbing) and Rod’s Plumbing Services, Inc. (Rod’s Plumbing), who perform emergency response and supplemental plumbing services for the General Services Department, Facility Services Division (GSD-Facility Services). This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the recommended action, GSD-Facility Services will be without an efficient way to procure emergency response or supplemental plumbing services. GSD-Facility Services would also be required to secure competitive bids for future service needs, which could delay plumbing services in situations that require immediate intervention when County staff and/or resources are limited.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action, which will increase the maximum compensation by $1,000,000 to $2,000,000. All costs associated with these services are funded through chargebacks to user departments. Sufficient appropriations and estimated revenues are included in the Internal Services Department, Facility Services Org 8935 FY 2024-25 Adopted Budget and will be included in future General Services Department Recommended Budget requests for the duration of the Agreement term. As of February 28, 2025, there are 26 pending invoices totaling $292,045.

 

DISCUSSION:

 

On October 10, 2023, the Board approved the Master Agreement for emergency response and supplemental plumbing services effective upon execution. These services are utilized in situations that pose an immediate risk to County employees, citizens, property and/or business operations and require immediate intervention, including but not limited to: hydro flushing, sewer line video detections, electronic leak detection and line locating, pipe services, excavating, sewer line services, sewer lining, and sewer pulling.

 

Approval of the recommended action will approve the First Amendment to the Master Agreement to increase the maximum compensation by $1,000,000 to $2,000,000. Service costs have exceeded the current maximum compensation due to the size and scale of recent emergency incidents, including:

                     In April of 2024, damage to the main water line located at Courthouse Park resulted in the loss of water to the Hall of Records, the South Annex Jail, the Courthouse, and the Sheriff’s Administration Building, requiring immediate repair to restore water to and from these buildings.

                     In April of 2024, damage to the main sewer line at the Recorder’s Office necessitated immediate repairs to restore water to and from that building.

                     In May of 2024, there was a major leak on the hydronics system located at the Juvenile Justice Campus (JJC), which supplies hot water to the pods that house juvenile inmates, and the system required immediate repairs to avoid temporarily shutting down the JJC and displacing the juveniles.

 

Per County Charter Section 13, approval of the recommended Agreement requires four affirmative votes of the Board of Supervisors as some of the contracted services can be, and are currently being, performed by County employees. While there is some overlap in services, both Reliable Plumbing and Rod’s Plumbing are contracted to provide services that are emergent in nature or otherwise cannot be managed by County staff. These emergency situations usually require specialized equipment that the County does not have access to, necessitating outside help to respond. Internal County procedures are in place to ensure that the services of County staff are prioritized, and that both Reliable Plumbing and Rod’s Plumbing are to be utilized only when the County is unable to appropriately respond to the emergency. While these services are provided on an infrequent basis, due to the unpredictable nature of the emergencies, staff will continue to monitor the usage and necessity of the Agreement. Should there be a greater need in the future, staff will present their findings to the Board with a request to either increase staffing levels and/or purchase additional equipment, as appropriate.
