SUBMITTED BY:                     Steven E. White, Director

                     Department of Public Works and Planning

SUBJECT:                     Road Acceptances / Recordings Report (FY 2019-20 through  FY 2025-26)

RECOMMENDED ACTION(S):

TITLE

1.                     Accept and file multi-year road acceptances / recordings report (FY 2019-20 through FY 2025-26); and

2.                     Direct staff to prepare and submit annual Board Briefing Reports on or around July of each calendar year in lieu of a Board Agenda Item covering the prior fiscal year’s road acceptances and recordings.

REPORT

There is no Net County Cost associated with the recommended actions. Approval of the first recommended action will allow your Board to formally accept a report summarizing road acceptances / recordings (FY 2019-20 through FY 2025-26).

Approval of the second recommended action will streamline future reporting and allow staff to prepare and distribute an annual Board Briefing Report on / around July of each calendar year summarizing the prior fiscal year road acceptances / recordings, in lieu of preparing a Board Agenda Item. This item is countywide.

ALTERNATIVE ACTION(S):

Your Board may choose not to approve the recommended actions, and the Department will continue to prepare an annual Board Agenda Item summarizing the road acceptances / recordings.

FISCAL IMPACT:

There is no Net County Cost associated with the recommended actions.

DISCUSSION:

When developments adjacent to County roads are approved, conditions are often established that require improvements to the County-road system commensurate with the additional traffic generated by the development. To accommodate the required roadway improvements, additional right-of-way must be dedicated to the County by the property owner(s), accepted into the County-road system, and approved for recordation.

On December 4, 2018, the Board of Supervisors approved amending the Fresno County Ordinance Code, Chapter 2.52 - Department of Public Works and Planning to add Paragraph M to Section 2.52.040 - Duties of Director of Public Works and Planning, designating the Director authority to accept roads or portions thereof into the County-road system. Dedications of right-of-way follows the same development review process and only the final steps associated with the acceptance and recordation are streamlined through the Director.

Annual reports were not brought forward for FY 2019-20 through FY 2025-26, resulting in the current report consolidating road acceptances and recordings completed during that period. The item was not brought forward to the Board for FY 2019-20 through FY2025-26 due to the initial operational impacts of the COVID-19 pandemic, which resulted in competing priorities and the redirection of staff resources, followed by departmental restructuring and changes in staffing and assigned responsibilities. These circumstances contributed to the delayed development and completion of the item for presentation to the Board. The Department of Public Works and Planning, Design Division - Right of Way unit has since been established, with staff completing multi-year training and certification through the International Right-of-Way Association and assigned responsibilities of the reporting moving forward.

Approval of the second recommended action will allow this information to be provided annually through a Board Briefing Report on or around July following the close of each fiscal year. The proposed Board Briefing Report format would continue to provide the Board with the required annual reporting while streamlining the communication process, as no formal Board action is required. This change would not modify the Director’s existing delegated authority and would only change the format used to report completed acceptances and recordings to your Board.

Exhibit A summarizes road acceptances and recordings completed under the Director’s authority and is organized by year of recordation in descending order from FY 2025-26 through FY 2019-20.
