SUBJECT:                     Amendment I to Revenue Agreement with CDPH for Immunization Program Services

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Amendment I to Agreement No. 17-638 with the California Department of Public Health for immunization services, reducing total compensation by $86,283, effective upon execution through June 30, 2022 ($2,310,402).

REPORT

The recommended action will decrease grant funding provided to the Department by the California Department of Public Health (CDPH) for local immunization services by $28,761 per year for the remaining three years of the grant, for a total decrease of $86,283, with no change to Net County Cost. Federal budgetary constraints have resulted in funding decreases to CDPH and statewide reductions to local assistance funds. The recommended amendment includes a revised scope of work with commensurately fewer required activities. This item is Countywide.

 

ALTERNATIVE ACTION(S):

 

There is no alternative action. CDPH will not reimburse the Department for costs above the reduced grant amount.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The annual allocation for the three remaining years in the grant will be reduced by $28,761 (6%) per year, for a total reduction of $86,283. The maximum compensation will be revised to $450,576 per year for the remaining three years, for a total of $2,310,402 over the five-year term.

 

The existing agreement allows indirect cost recovery capped at 25% of salaries and benefits, but the program is maximizing all available funds on direct costs. Health Realignment will cover the grant’s indirect costs at the Department’s full rate of 25.42% ($98,315) for FY 2019-20, and will continue to cover costs in subsequent years. Sufficient appropriations and estimated revenues were included in the Department’s Org 5620 FY 2019-20 Adopted Budget and will be requested in subsequent fiscal years. 

 

DISCUSSION:

 

On December 12, 2017, the Board approved revenue Agreement No. 17-638 with CDPH for mandated local immunization programs. The grant also supports seasonal flu clinics, case management services for Perinatal Hepatitis B patients, health education, and outreach. The Department has received stable funding for over 30 years, but CDPH must reduce local assistance grants due to recent Federal budgetary constraints.

 

The Department has accommodated the reduction by transferring support staff to other programs and by adopting appointment scheduling for the immunization clinic. Although walk in clients will not be turned away, the appointment scheduling provides staff sufficient planning time to meet the public’s needs. The Department will continue to serve the immunization needs of residents and their children as required for school registration or foreign travel and will work to maintain the County’s higher than average rate of kindergarteners with all required immunizations (96.1% vs. 95.1% Statewide in 2017).

 

The existing agreement contains non-standard language in that it authorizes the State to cancel or terminate without cause by giving 30 calendar days advance written notice to the County, or amend the Agreement to reflect reduction in funds.  The agreement also contains non-standard County general indemnification and intellectual property indemnification provisions, which require the County to indemnify the State and does not contain reciprocal language.
