SUBJECT: Agreement with the Malaga County Water District for the Malaga Water Well Upgrades, Community Development Block Grant (CDBG) Project No. 16451
RECOMMENDED ACTION:
TITLE
Approve and authorize Chairman to execute Agreement with the Malaga County Water District for the Malaga Water Well Upgrades, Community Development Block Grant Project No. 16451 ($250,000).
REPORT
The Agreement provides Community Development Block Grant (CDBG) funding for the Malaga Water Well Upgrades Project totaling $250,000. The project is included in the County’s 2016-17 Action Plan which was approved by the Board on April 26, 2016.
ALTERNATIVE ACTION:
The Board may reject the project and proceed to amend the 2016-17 Action Plan to delete the Malaga Water Well Upgrades Project and direct staff to identify another project on the 2016-2017 Back Up list for consideration. However, deletion of this project may impact the County’s ability to meet its CDBG expenditure timelines, which are set by U.S. Department of Housing and Urban Development.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended action. The total estimated project cost is $414,000. CDBG funds for the Malaga Water Well Upgrades Project, in the amount of $250,000 from the County’s unincorporated area allocation, are included in the Department’s Community Development Block Grant Org 7205 Adopted Budget for FY 2016-17. CDBG funds are provided on a reimbursement basis. The Malaga County Water District will provide all sums of money in excess of the CDBG funds that may be necessary to complete the project.
DISCUSSION:
On April 26, 2016, the Board approved the 2016-17 Unincorporated Area Projects list as part of the Annual Action Plan, which included the Malaga Water Well Upgrades Project on the Back Up list should funding become available. Due to year-end cost savings from other CDBG activities, there are now sufficient funds for this project.
The Malaga Water Well Upgrades Project consists of the installation of a variable frequency drive at the District’s Well No. 6, and supervisory control and data acquisition (SCADA) improvements at Well Nos. 6, 7, and 8. The Project will improve the operating efficiency and reliability of the District’s water wells. The Project is
located at District-owned Water Well Nos. 6 (APNs 330-031-55ST and 330-031-66ST), 7 (APN 331-100-59ST), and 8 (APN 330-212-29T), as well as at the District’s public works office located at 3392 W. Central Avenue (APN 331-130-25T).
In addition to providing funds for the Malaga Water Well Upgrades Project, the Agreement requires that the Malaga County Water District prepare the plans and specifications for the project that conform with Federal and State regulations governing Federally-assisted projects. The Agreement also provides that the District be responsible for the advertising and awarding of the project to the lowest responsible bidder and for completion of the necessary construction engineering. The County agrees to review and approve the plans and specifications for compliance with Federal regulations prior to the District advertising of the project for bid. The Malaga County Water District agrees to maintain the improvements after project completion.
Initial Study/Environmental Assessment No. 7204 was completed for the Malaga Water Well Upgrades Project under the provisions of the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA). Based on the environmental review, the project is categorically exempt from the provisions of the CEQA Guidelines under Section 15301, Class 1 - Existing Facilities. Under Section 15301, a Class 1 exemption consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use. It has also been determined that the project is exempt per Section 58.34 (a)(12) of the NEPA Guidelines because the project meets the requirements for a categorical exclusion under Section 58.35 (a).
OTHER REVIEWING AGENCIES:
The Agreement has been reviewed and approved by the Malaga County Water District.
