DATE: October 20, 2026
TO: Board of Supervisors
SUBMITTED BY: Hollis Magill, Director of Human Resources
SUBJECT: Memorandum of Understanding for Representation Unit 11
RECOMMENDED ACTION(S):
TITLE
1. Approve the successor Memorandum of Understanding for Representation Unit 11, represented by the Fresno County Deputy Probation Officers Association, effective October 26, 2026; and
2. Approve a related 1.5% increase in base salary for the unrepresented Supervising Deputy Probation Officer and extra-help Special Probation Investigator classifications, due to compaction and in keeping with footnote four (4) of the Salary Resolution, respectively, effective October 26, 2026; and
3. Approve a related 4.95% increase in base salary for the unrepresented Supervising Deputy Probation Officer classification, effective November 9, 2026, in lieu of the previously approved 1% base salary increase for UNR classifications at the September 22, 2026, Board of Supervisors Meeting, to account for compaction resulting from the addition of a sixth salary step to their subordinate Senior Deputy Probation Officer classification; and
4. Approve the related Salary Resolution Amendment, as reflected on Appendix “B”.
REPORT
Approval of the recommended actions would effectuate the tentatively agreed upon terms and conditions as delineated herein regarding a successor Memorandum of Understanding (MOU) for Representation Unit 11, effective October 26, 2026, through October 24, 2027. The estimated cost of the negotiated terms and conditions for FY 2026-27 is $1,013,000; $522,000 of which is Net County Cost (NCC). The estimated cost of the negotiated terms and conditions for FY 2027-28 is $1,154,000; $594,000 of which is NCC. Impacted department appropriations will be monitored, and adjustments will be brought to your Board prior to fiscal year-end if needed.
ALTERNATIVE ACTION(S):
If your Board were not to approve the recommended actions, the existing terms and conditions would remain in effect and contract negotiations would continue.
FISCAL IMPACT:
The total estimated cost of the negotiated terms and conditions for FY 2026-27 is approximately $1,013,000, including related retirement costs, $522,000 of which is NCC. Impacted department appropriations will be monitored, and adjustments will be brought to your Board prior to fiscal year-end if needed. The total cost for FY 2027-28 is approximately $1,154,000; $594,000 of which is NCC. Sufficient appropriations will be included in impacted Department’s FY 2027-28 recommended budget request.
DISCUSSION:
The first recommended action is consistent with your Board’s direction; your Board’s representatives reached a tentative agreement for a successor MOU that was subsequently ratified by the Deputy Probation Officers Association (latest MOU expired July 5, 2026).
• MOU Term:
Ø October 26, 2026, through October 24, 2027.
• Salary Adjustments:
Ø Effective October 26, 2026:
§ 1.5% increase for all classifications.
Ø Salary Reopener:
§ Should any other safety group, currently in bargaining, receive a higher salary increase, the parties agree to reopen the MOU to discuss salary.
• Addition of Sixth Step (Step 6), effective November 9, 2026:
Ø Additional Salary step for all classifications in Unit 11.
Ø Modify Salary Resolution Section 411.2 (Advance from Step 1 to Step 2) from 13 pay periods to 26 pay periods for Representation Unit 11.
• Shift Premium:
Ø Increase from 6% to 8%, effective October 26, 2026.
• Annual Leave:
Ø Increase cap from 600 hours to 650 hours, effective October 26, 2026.
• Retirement Actuarial Study:
Ø The County will initiate the procurement of an actuarial study during the term of this agreement to assess the impacts and costs of potentially providing a cost-of-living adjustment (COLA) to existing retirement Tiers IV and V or creating new retirement tiers with a COLA provision. The County will coordinate with Fresno County Employees Retirement Association (FCERA) to ensure efficiency and that statutory requirements with the County Employees Retirement Law (CERL) are met.
• Miscellaneous:
Ø Addition, update, or deletion of MOU language and/or addenda.
The second recommended action is consistent with your Board’s direction to maintain a minimum compaction between the supervisory and subordinate classifications, which results in a 1.5% increase to the unrepresented Supervising Deputy Probation Officer classification. Additionally, the second recommended action makes conforming changes to the hourly rate of the extra-help Special Probation Investigator classification, whose rate is stipulated in Footnote 4 of the Salary Resolution.
The third recommended action again results from your Board’s direction to maintain minimum compaction between supervisory and subordinate classifications. This is accomplished by replacing the previously approved 1% UNR base salary increase, approved at the September 22, 2026, Board of Supervisors meeting, with a 4.95% base salary increase for the unrepresented Supervising Deputy Probation Officer classification to account for the addition of a sixth salary step to the Senior Deputy Probation Officer classification effective November 9, 2026.
The fourth recommended action effectuates the above recommended actions within the County Salary Resolution.
