SUBJECT: Resolution Calling Special Election for Pleasant Valley Water District’s Board of Directors
RECOMMENDED ACTION(S):
TITLE
Consider and adopt a Resolution calling a special election on August 20, 2024, to elect four (4) members of the Pleasant Valley Water District’s Board of Directors to a full-term, set to expire on December 3, 2027.
REPORT
Approval of recommended action will allow the Fresno County Board of Supervisors to call a special election for the purpose of electing four (4) members to the Pleasant Valley Water District’s Board of Directors. There is no Net County Cost. This item pertains to District 4.
ALTERNATIVE ACTION(S):
There is no alternative action. If the Board does not call the special election, the voters of the Pleasant Valley Water District (“District”) will not have the opportunity to elect members to the District’s Board of Directors.
FISCAL IMPACT:
There is no increase in Net County Cost associated with this action.
DISCUSSION:
On January 31, 2024, the District filed Resolution No. 2023-2024-02 with the Clerk of the Board’s Office requesting the Board to call a special election for four (4) members of the District’s Board of Directors pursuant to Elections Code section 10004. The Resolution confirms that the District’s Board of Directors inadvertently failed to call its general election for November 7, 2023, and that the District will conduct and pay for the special election and does not require the assistance of the County Clerk/Registrar of Voters.
Elections Code section 10004 states: “If the governing body of any special district fails to call or to take any other steps necessary to the holding of the regular district election at which any member or members of the governing body of the district are to be selected, the board of supervisors of the county in which the district is located, upon being notified of this fact by any voter in the district, may call a special election within the district for the selection of the governing board member or members involved. The election shall be held not later than 90 days after it is called by the board of supervisors, and shall be conducted in the same manner as the regular district election. The costs of the special election shall be borne by the district for which the election is held.”
The District confirmed that it is prepared to hold the special election within the District on August 20, 2024.
