SUBJECT:                     Amendments to the Conflict of Interest Code for One Agency

 

RECOMMENDED ACTION(S):

TITLE

Approve amendments to Conflict of Interest Code for International Water District

REPORT

The International Water District updated their Conflict of Interest (COI) Code, which requires amendments to be approved by your Board.  There is no Net County Cost.  This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Your Board may approve the COI Code as submitted, revise the proposed COI Code and approve it as revised, or return the proposed COI Code to the agency for revision and resubmission. If the recommended action is not approved, the agency will not be able to comply with Government Code section 87306 requesting local agencies amend a COI Code when change is necessitated by changed circumstances.

 

FISCAL IMPACT:

 

There is no increase in net County cost associated with this action.

 

DISCUSSION:

 

Following the biennial review of their COI Code as required by Government Code section 87306.5, the International Water District amended their COI Code to correct the filing locations for Statements of Economic Interests and list correct titles for designated positions.

 

Amendments to local agency COI Codes are authorized by section 87306 of the Government Code whenever changes are required by changed circumstances, by creation or deletion of designated positions, or by changes in the duty of such positions. The proposed COI Code, as amended and corrected, is lawful under the Political Reform Act of 1974. Pursuant to sections 82011 and 87303 of the Government Code, the Board of Supervisors is the code reviewing body and may approve the code as submitted, revise the proposed code and approve it as revised, or return the proposed code to the agency for revision and resubmission.
