SUBJECT: Award Contract 22-02-C American Avenue Shoulder Improvements Placer Avenue to Madera Avenue

RECOMMENDED ACTION(S):
TITLE
1. Adopt plans and specifications for Contract No. 22-02-C American Avenue Shoulder Improvements Placer Avenue to Madera Avenue, Federal Project No. CML-5942(284); and

2. Hear and consider bid protest from apparent second low bidder, Cal Valley Construction, Inc. 5125 N Gates Avenue #102, Fresno, CA 93722, regarding the proposed award of Contract No. 22-02-C to the apparent low bidder, Yarbs Grading & Paving, Inc., 11339 S. Peach Avenue, Fresno, CA 93725; and

3. Award Contract No. 22-02-C to the bidder with the lowest responsible bid as determined by the Board after consideration of the bid protest.
REPORT
Approval of the recommended actions will authorize the award of a Federally funded Congestion Mitigation and Air Quality Improvement Program (CMAQ) project. This item pertains to a location in District 1.

ALTERNATIVE ACTION(S):

If the recommended actions are not approved, the project will be delayed. Your Board may instead choose to reject all bids and re-bid the project, which would result in the project's construction being delayed by several months.

FISCAL IMPACT:

There is no Net County Cost associated with the recommended actions. The anticipated construction cost for the project, based on the low bid and Director's allowance for change orders is estimated to be $2.8 million. This project is 88.53% Federally funded through the CMAQ. The local match of 11.47% will be paid out of the Road Fund. Sufficient appropriations and estimated revenues are included in the Department of Public Works and Planning - Roads Org 4510 FY 2022-23 Proposed Budget.
