SUBJECT: Amendment II to Agreement A-13-767-1
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute Cover Page Agreement-Amendment, a required administrative form, for Amendment II to Cooperative Agreement No. 13-767-1 between the County and the California High Speed Rail Authority (HSRA) to add a max contract amount of $3,700,000 to be paid to the County, as well as any further documents required to complete this settlement, subject to review as to legal form by County Counsel.
REPORT
There is no increase to Net County Cost associated with this item. On September 9, 2025, your Board approved Amendment II to Agreement No. 13-767-1 and Settlement Agreement No. 25-470 with HSRA to acknowledge HSRA and HSRA's contractor liability to the County for damage to County Roads and settlement to pay a sum of $3,700,000 to the County to remediate and repair damages to County roads. Approval of the recommended action would authorize the Chairman to execute a required administrative form for the existing agreement with HSRA to add and allow for the settlement payment of $3,700,000 to be paid by HSRS to the County, as well as any additional documents required to complete the settlement. This item pertains to locations in Districts 1, 3, and 4.
ALTERNATIVE ACTION(S):
Your Board may choose not to execute the required form; however, HSRA will be unable to pay the County the sum of $3,700,000 to remediate and repair damages to County roads.
FISCAL IMPACT:
There is no increase to Net County Cost associated with this item. The revenues received from the settlement is included in the Public Works and Planning's (Department) Road Org 4510 FY 2025-26 Adopted Budget.
