SUBJECT: Retroactive Second Amendment to Agreement with Superior Court of California
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute a retroactive Second Amendment to Agreement No. 23-357 with the Superior Court of California, County of Fresno for Court case management system, door access, Wi-Fi, badge, and printer services, effective July 1, 2026, with no change to the term of August 1, 2023 to July 31, 2028, updating the Court's services rates, and increase the maximum by $79,320 to a total of $679,320.
REPORT
There is no increase in Net County Cost associated with the recommended action. Approval of the recommended action will authorize a retroactive Second Amendment to Agreement No. 23-357 with the Superior Court of California, County of Fresno (Court), effective July 1, 2026, to update the Court's schedule of service rates, increase the annual and total maximum compensation under the Agreement, and ensure the County's continued access to Court case management system (CMS), door access, Wi-Fi, badge, and courtroom printer services for participating County departments. This item is countywide.
ALTERNATIVE ACTION(S):
There is no viable alternative action. If your Board does not approve the recommended action, the County will be unable to reimburse the Court for services at the revised rates effective July 1, 2026, which may impact continued access to Court services provided under the Agreement.
RETROACTIVE AGREEMENT:
The Court notified the County of the updated service rates on June 11, 2026. The proposed Second Amendment is retroactive to July 1, 2026, to coincide with the Court's implementation of revised service rates following completion of a Court time cost study. Additional time was required to coordinate the revised rates and proposed agreement updates with participating County departments.
