SUBJECT: Amendments to the Conflict of Interest Code for Two Agencies

RECOMMENDED ACTION(S):
TITLE
Approve amendments to Conflict of Interest Codes for Fresno County Civil Service Commission and Clovis Cemetery District.
REPORT
The Fresno County Civil Service Commission and Clovis Cemetery District updated their Conflict of Interest (COI) Codes, which require amendments to be approved by your Board. There is no Net County Cost. This item is countywide.

ALTERNATIVE ACTION(S):

Your Board may approve the COI Codes as submitted, revise the proposed COI Codes and approve them as revised, or return the proposed COI Codes to the agencies for revision and resubmission. If the recommended action is not approved, these agencies will not be able to comply with Government Code section 87306 requesting local agencies amend a COI Code when change is necessitated by changed circumstances.

FISCAL IMPACT:

There is no increase in net County cost associated with this action.

DISCUSSION:

Following the biennial review of their COI Codes as required by Government Code section 87306.5, the Fresno County Civil Service Commission and Clovis Cemetery District amended their COI Codes to correct the list of public officials who manage public investments.

Amendments to local agency COI Codes are authorized by section 87306 of the Government Code whenever changes are required by changed circumstances, by creation or deletion of designated positions, or by changes in the duty of such positions. The proposed COI Codes, as amended and corrected, are lawful under the Political Reform Act of 1974. Pursuant to sections 82011 and 87303 of the Government Code, the Board of Supervisors is the code reviewing body and may approve the codes as submitted, revise the proposed codes and approve them as revised, or return the proposed codes to the agencies for revision and resubmission.
