SUBJECT: Conflict of Interest Codes for Waterworks Districts
RECOMMENDED ACTION(S):
TITLE
Sitting as the Board of Directors of Waterworks District Nos. 37, 38, 40, 41, and 42:
Consider and approve amendments to the Conflict of Interest Codes for each Waterworks District

REPORT
Approval of the recommended action will approve and adopt the amended Conflict of Interest (COI) Codes for each of the identified Waterworks Districts (WWDs). This item pertains to District 5.
ALTERNATIVE ACTION(S):
Your Board may approve the proposed amended COI Codes as submitted or revise the proposed amended COI Codes and approve them as revised. If the recommended action is not approved, the WWDs will not be able to comply with Government Code section 87306, which requires local agencies to amend a COI Code when change is necessitated.
FISCAL IMPACT:
There is no increase in Net County Cost associated with this recommended action.
DISCUSSION:
Government Code section 87306(a) requires local agencies like the identified WWDs to amend their COI Codes when change is necessitated by changed circumstances, including the creation of new designated positions and changes to the duties of existing positions. The COI Codes for the identified WWDs have not been updated since 1977 and require amendments due to changed circumstances and updates to the Political Reform Act of 1974 and the related regulations.
Pursuant to Government Code section 82011, your Board serves as the COI Code Reviewing Body for the WWDs, and Government Code section 87303 requires your Board to approve the amended COI Codes for them to be adopted and effective.
