SUBJECT: Amend the Bylaws of the Fresno County Behavioral Health Board
RECOMMENDED ACTION(S):
TITLE
Approve the amended Fresno County Behavioral Health Board Bylaws.
REPORT
There is no additional Net County Cost associated with the recommended action. With the passing of Proposition 1 (SB 326) local behavioral health boards are required to amend their bylaws in accordance with modifications to Welfare and Institutions Code 5604 and 5963.03 which regulate California Behavioral Health Boards Bylaws, Duties, Expenses, and Membership. On November 20, 2024 the Fresno County Behavioral Health Board (FCBHB) amended its bylaws by a unanimous vote of its members and is now seeking your Board's approval. The terms of the bylaws require that your Board approve amendments to the bylaws. This item is countywide.
ALTERNATIVE ACTION(S):
If your board does not approve the amended bylaws, the FCBHB will not be in compliance with new legislation requirements for California Behavioral Health Boards.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action.
DISCUSSION:
On March 24, 2015, the Board adopted Resolution Number 15-080, consolidating the Fresno County Mental Health Board and Alcohol and Drug Advisory Board to create the FCBHB. The FCBHB is the public advisory board on adult, children's, and justice system mental health and alcohol and substance use disorder (SUD) issues, whose duties and functions are delineated in the Welfare and Institutions Code (WIC) and the Health and Safety Code (HSC).
On October 13, 2015, the Board approved the bylaws of the newly formed FCBHB.
On December 18, 2018, the Board approved Amendment I to the FCBHB bylaws as described below:
